Hello, I've been paying CapitalOne Bank payment protection from April 2002 until Dec. 2004. I was unemployed on June 23rd 2003. CapitalOne didn't honor their payment protection plan. I continued to pay payment protection. I figured I'd go back to work and I always had proof that they didn't honor their plan. I'm still unmeployed. CapitalOne has been calling. I told them that they didn't honor their plan.I was told to call back the next day because they had to search their archives. I have 3 accounts so I had to send in 3 different forms for each account. When I called CapitalOne they told me that they never received my forms. That's a lie because they have case numbers for each card. When the forms are sent out they're blank. You have to have imformation filled out by your ex employer and yourself. No case number is on the form because you haven't filled out anything. Therefore they had too have received the forms to have assigned case numbers. I told them to refund my full amount since I've been in the program.I was given the run around. I told them how conveinent that they lost 3 serparte forms mailed separtely. I was told to fill out the forms again.

May 6, 2005 To Whom It May Concern: Reference: Capital One Account To whom it may concern: Illegal fees have been applied during 3 different insurance claims June 2001,April 2002,and November 2003 that has never been corrected by Capital One Financial Specialist Angel Flippen. 1. Capital One delayed in approving my claim on June 05, 2001and defaulted in payments for 2 months Capital One made only partial minimum payments of a total of $102.21, for an 8 months period and refused to make full minimum payments that far exceeded $102.00 . I was charged during this claim alone from June 08,2001 through March 08 2002 a total of $350.00 in overlimit and late fees and was also charged payment protection insurance premiums fees of $40.69 a total of $390.69 in fees not including interest charges on this claim. Capital One reimbursed $100.00 to this claim to my account on March 08, 2002. This leaves a remaining balance owed on this claim only, to the cardholder of overlimit and late fees and insurance premiums that were not waived or reimbursed in accordance with Capital One Addendum. 2. Capital One delayed in approving my 2nd claim filed on April 28,2002 through April 28,2003 and defaulted in making payments for 5 months, my first payment was applied by Capital One on October 08, 2002 in the amount $221.33. Capital One made only partial minimum payments for 1 year on this claim $370.41 was paid, someone refused to make full minimum payments that far exceed this amount. I was charged from April 23,2002 through April 23 2003 a total of $464.00 in overlimit and late fees and was charged payment protection insurance premiums fees of $67.84 a total of $531.84. Capital One reimbursed to my account fees that were charged in the amount of $116.00 on December 08, 2002. Capital One issued a partial reimbursement check for the permanent disability in the amount of $377.00 April 14, for fees only charged during this 2002 claim. This leaves a remainin g balance owed to the cardholder on this claim also and late fees and insurance premiums that were not waived in accordance with Capital One Addendum. 3. Capital One delayed in approving my 3rd claim for 8 months on my permanent disability claim that was approved on June 07,2004 that was filed on November 17,2003 and Capital One defaulted in paying off my balance owed (see enclosures). Capital One paid $43.97 one partial minimum payments during my permanent disabilty and refused to make the full minimum payment of $1154.90 balance owed. I the cardholder and insured with Capital One payment protection insurance with a permanent disability had to pay off Capital One's owed balance in the amount of $1190.05 due to continuous harassment of 6 automatic phone calls made to my home per day. Capital one reimbursed on February 08, 2004 $87.00 for fees. Capital One issued a partial reimbursement check for my permanent disability on June 07, 2004 in the amount $365.03 of the $1190.05 that I paid in full because Capital One refused to pay this balance or waive overlimit and late fees and payment protection insurance fees. I did not incur these above fees during these valid claims; Capital One has incurred these fees as well as increasing my balance with additional interest and fees and never making full minimum payments during a valid claim on my account for a three years period 2000-2003 that has not been corrected. I the insured cardholder on this claim paid the $1190.05 of a paid in full balance. This leaves a remaining balance owed to the cardholder on this claim only in the amount for fees alone in the amount of $854.20 of overlimit and late fees interest periodic daily interest and insurance premiums that were not waived in accordance with Capital One Addendum nor reimbursed, as I stated Capital One created this by not making full minimum payments during 3 different valid claims and not correcting this account 3 years ago. This activity is not in accordance with Capital One Addendum or Disclosure. Yes I am more than aware of Capital Ones fees, however this subject issue is of applied fees increased interest increased periodic daily interest and increased payment protection premiums during valid unemployment and disability insurance claims. Full minimum payments were never paid during 3 different periods of a unemployment claim and a disability claim and a permanent disability claim. Capital One is the cause of my balance increasing intentionally, knowingly and willfully, with fees that increased from $25.00 to $29.00 not in accordance with Capital One Disclosure statement, etc. See: Question # 8 Answers to your Payment Protection question Question: How does activating Payment Protection benefit my account? Answer: For unemployment and temporary disability claims payment Protection Pays the entire minimum monthly payment on your eligible balance plus the monthly charge for payment protection and for death and permanent total disability claims your eligible balance is paid in full. Waivers (l) Before a claim you are responsible for past due and overlimit fees incurred on your account before the date of loss. (ll )As a result of loss, If you are eligible for benefit payments and file valid notice of claim, Capital One will access you account status as of the date of loss and going forward to the date you become eligible, if the amount of the benefit would had prevented your account from being charged past due or overlimit fees in that period of time Payment protection will pay those fees on your behalf. After loss: You are responsible for overlimit fees Please note that Capital One misleads their customers with their insurance because it states Payment Protection will pay up to $10,000.00 or whichever is less on your eligible balance it does not state in the addendum $10,000.00or less on my credit limit because with my K-Mart Line of Credit is $400 and non K-mart is $300.00 and cash advance is limit is $300.00. Capital One claims they will not pay more than my credit limit that I charged during my period of being a cardholder which was $300.00. Where did the remaining $835.00 dollars go that I was not reimbursed when I paid off the balance of $1190.05 and if my credit limit was all that was to be paid why did they accept over a $300.00 payment? Capital One never AT ANYTIME MADE ONE FULL MINIMUM PAYMENT during a valid claim and in accordance with Capital Ones Addendum payment protection. Capital One personally needs to correct my account of the inaccurate balance and remove according to your addendum all payment protection insurance fees and membership fees late fees and overlimit fees increased interest periodic daily interest that has continually being charged to my account during valid insurance claims of 2001,2002,2003 and carried over to my account when the claim ended, as well as carried over onto my account at the beginning of a new claim during the claim and ending of a claim.
