Well it all started back in 2004 and I received my first credit card from Bank of America. I kept paying on the card, did well... I got a few more credit card offers and should not have accepted... The offer was too tempting, so pretty soon I got an offer from Capital One.It had $1000.00 credit limit. I decided what the heck. I will only get it for a "just in case". Well I used it to purchase food because and other such items that I could not have paid for with my low weekly paycheck and other such goods that were already going to rent and utiliies. I also helped pay for gas and what not for my roomate. Then my capital one credit card account was sent to collections, Suttel and Assocaites P.S. Attorneys at law? What the heck. SO unfortunately, I couldnt pay the minimum payment because I had lost my job and even had to move in with my roommates parents and such. Of course, hte bills followed me and kept on piling up.. I was working but not nearly making enough to cover the minimum payment which had skyrocketed due to lack of a job. Now presently , I just have recieved a summons to appear in court because they want to sue me to garnish wages so they can recover the amount due to Capital One.

Also on my summons there is no Number on it. I do have 20 days to respond from today. Well Please if anyone has any advice please let me know what I should do.

You could PAY the debt. That will certainly end the problem. You could try to negotiate a settlement for the debt, whereas you would pay them a lesser amount and they will consider the debt absolved. IF your financial situation is so dire, you should consult with a bankruptcy attorney-bankruptcy protection might be a viable option for you. Do NOT IGNORE the summons. If you ignore it and do not show up in court, they will win a default judgment against you- then the real fun begins; wage garnishments, levy against bank accounts, liens against any property of value, etc. I don't see a ripoff here. You used the credit, didn't pay it off, and now they're sueing you for the balance of the debt. That's the way it works. Good luck.
