To the person who wrote below comment: ....Why would you deserve an award for nothing more than an inconvenience for a few seconds? Please don't tell me it's causing emotional distress. Give me a break.Jessica You must be a collection agent. And it's not a few seconds. My uncle went thru this ordeal they called him at all hours of day and night. This and other credit card companies. In this case, he had the same name as the real person they were looking for. Except my uncle is 86yrs and the other guy is 30 yrs. old. Day after day he had to verify his personal info. Everyday same companies would call again demanding payment to accounts he never had. This went on for a year and a half. They all said, were sorry we won't call again but did. This person is 86 yrs. old and sick. He was scared that someone had stolen his identity, and this really caused emotional distress. Had to go on extra medication for blood pressure. It did not matter that his phone was listed with Do-not-call. they called anyway. This companies are Piranas, they don't care if they give anyone a heart attack. And they have unlawful practices. You cannot accuse anyone without proof. Screaming and threatening are not correct customer service practices. All they had to do was check on the internet and find the correct address and phone for the real person. I did in less than five minutes. Also reported these companies to Do-not-call and to Federal authorities. That's when they stopped calling.

This is how I stopped the phone calls, and hope that this information may be beneficial to someone else that experiences a similar situation. First I filed a complaint with my states Attorney General's office which resulted in a lame excuse letter from Capital One, apologizing for any inconvenience, yet denying any previous requests to stop the calls. Then, I did some research and identified all officers of the corporation. I contacted the Capital One's executive offices and emailed the corporate office (investment and relations departments) to advise that them that should the calls continue, I would contact each and every officer of the corporation listed in my email every time I received a call their company, (preferably at the officer's home or cell number). Thankfully I do not have Capital One card in my wallet! As an added note: Jeff- East Wenatchee, WA Thanks for the advice, I was already registered with the Do Not Call Registry, but Capital One seems to have gone around this restriction since they were attempting to collect a debt from someone that had our phone number a year ago. Jessica Long Beach California How about if we put your phone number on a dialer to from India so that you receive three disturbing calls each day harassing you about a person that you do not know, especially if you are caring for disabled members in your household and see how you handle it? Our dog Jessica has more sense that you! I guess that is why we moved from CA.

Why is it that you seem to think that just because a number is on auto dial with Capital One collections dept, and as you stated may be on an account by error, that it is acceptable to have to tolerate these calls on a daily basis. Why is it so hard for Capital One to fix a problem instead of finding excuses for their ignorance and lack of customer service. I would bet that if you were to received 6, 8 , 10 phone calls daily from someone asking if you posted our payment that you would not be so inclined to say for use to deal with the calls. This is not legal but for some reason you people at CO have found a loop hole to get away with this harassment of it's customers. And don't even use the excuse that if we paid on time this would not happen, because there are many of us that can testify to the fact that your company has internal problems and are blaming the internal stupidity on the consumer instead of fixing what you people at CO already know is broke. I hope that we the consumer as a whole can figure out how to stop this illegal abuse and form now on when I deal with the customer service I will record my conversation with you as well and get the person I am speaking with their full name. Funny how easy it is to get a phone number of a person when you know how to go about it. I wonder how many phone calls you would accept at all hours of the day and night asking what you are doing to make your customers happier. But I will bet that it is CO's policy to never give your real full name just because of this reason. Funny you at CO have rights but your customers don't have any. Give me a break with your comments because you would not tolerate it if it were happening to you.

Why are you asking if anyone has filed suit and won an award for something like that? You really think you are deserving of money or 'an award' as you put it, because Capital One is calling your house? Collection calls run off what is called a 'dialer'. They automatically call for the cs rep. They probably have your number linked to another account. It happens on accident all the time. Sure, it must be a pain in the a*s, but seriously, why would you deserve an award for nothing more than an inconvenience for a few seconds? Please don't tell me it's causing emotional distress. Give me a break.

IF you don't have any kind of business relationship or have accepted any services from the company recently, you can avoid this scenerio of solicited calls for 5 years. There is a 31 day grace period after signing up. SO you can't go "head on" with guns blazing (reporting violators)until after the grace period of 31 days has completed, this is the waiting period after you register your phone number(s) Go to the Do Not Call Registry online and register all your phone numbers and you will be telemarketer free for 5 Years! IF anyone calls you without your explicit permission they will be subjected to a fine of $11,000 or other penalties deemed by the upper hand of the FTC. You can report them as Do-Not-Call violations. There are some exceptions to the rules and more info can be obtained directly from their website. One other thing to remember, you will need to be able to identify who's calling to report them in the first place, when they don't answer the phone.
