We started off like anyone else, looking for a good deal. Christina Roman (the secretary for CapSouth) answered our call about the property and put us in contact with Pam (with OK Close), who allowed us to look at the house. No one had any answers and had to " get back with us"... I should have known from the begining.
The house was a pre-forclosure that was purchased from Regions Bank... or so we were told. CapSouth was in the process of obtaining a clear title, which never happened. We settled on a price and were told that we had to sign a contract and put down a "good faith deposit." All we had at the time was $4900... so we wired them the funds.
After bending over backwards getting James MacMinn (the loan officer), of 1st Guaranty Mortgage Co, W-2's, paystubs and such, we were not approved, even though we had a preapproval letter. They kept saying, One more day, we should know something tomorrow...all of this was BS!!! Even after our said closing date had passed, Joe (the head loan officer) called us to say he had gotten us approved. We had had enough, and told them to give us our deposit back!!! We provided banking info for a wire, even gave our FEDEX account number to have it picked up... all to no avail. They keep saying the check has been put in the mail.
WAIT... where did they mail it??? they knew we had to move because our house had sold and they didnt hold up their end of the deal.
So here we are ZERO money in the bank, had to relocate a 2 year old... did I mention my wife is almost 8 months pregnant!!!

The only truth they have stated so far is that my wife is NOT a W2 employee... she has been for years, now she is her own boss and makes( even with the slow economy) twice what she has in years past. We told them up front that W2's would not be sufficient because of the change... so we gave them 6 months worth of vendor payments. ... yes we moved, I wish I could attach emails, we sold our house and had all of our eggs in "CapSouths" basket... 1st Guaranty Mortgage could not do what they said they could do... so the lady that bought our house wanted to move into what was hers... so we had to move!!! Everything was forwarded thru the USPS... we have gotten all of our other mail... why not our deposit??? ... as for our credit... how does 786 and 769 sound??? not too bad, huh?? Read the rebuttal carefully... "she did not forward her mail incorrectly"... CORRECT!! we did it correctly. ... timley manner??... 4/1/09 was our closing date... it is the 19th... still no refund. No refund after offering our banking info and our FEDEX account info for a pick-up at on cost to them our depsoit and no respons. ...After contacting the Department of Financial services(850-413-3100), the FL Real Estate Comission(407-245-0800), the Office of Financial Regulation(800-298-0485) and the U.S. Attorneys Office; we learned that Steve Lalonde is very well known... not a group I would like to be known by...

She is not telling you that she is not a w2 employee she mistated her income her loan was approved but she had to move. So she moved without telling us her new address and her refund was sent to her old address because she failed to inform anyone otherwise. Secondly she admitted she did not forward her mail incorrectly Thirdly she is failing to mention her credit issues. Unfortunately this did not happen because of her credit issues, income and inpatience. She is responsible for her credit and income no lender is not including us She was refunded in a timely manner. Maybe next time she will be a little more honest with her lender
