An internet petition is not going to be allowed into evidence - no way for cross examination or to verify the validity of the signers of the petition.

The FDCPA does apply to residents of California because of a California statute called the Rosenthal FDCPA. This statute basically limits certain CREDITORS to the same limitations imposed on debt collectors in the federal FDCPA. Further, the same penalties in the FDCPA apply to creditors who violate the Rosenthal FDCPA. Good luck.

Unfortunately, Robert is basically correct. This is a political problem. The citizens need to take back their government from corporate control and re-instate usury laws nationwide.

You didn't specify why you are suing CashCall. The outragous interest rates they charge are disclosed and beleive it or not LEGAL. They are also not a 3rd party collection agency, so the Fair Debt Collection Practices Act does not apply to them. This means they can do several things a collection agency can not do in order to try and get you to pay. If it is either of these two grounds you probably will end up loosing. In principal I hope it goes good for you. But the reality of it is that you may be opening yourself up to more problems. Good Luck
