Here is an example of the cease communication / cease and desist letter that I use. Modify it for your own use if you'd like. Good luck! Fight the fight! (Collection Agency) (Their address) RE: (Their account number and original creditor if you know it) Dear Collection Agency, This will serve as your legal notice under federal law of the Fair Debt Collection Practices Act of Congress (FDCPA), to cease ALL communication with me in reference to the above account. If you don't follow this notice, I will be forced to file a formal complaint against you with the United States government agency, the Federal Trade Commission, who is responsible for enforcement, the state Attorny General's Office and the American Collector's Association who monitors collection agencies for non-compliance with this federal law. I have decided that I don't desire to work with a collection agency under ANY circumstances. I will contact the alleged original creditor of this alleged debt to resolve this matter directly. You are also notified that if any adverse items are placed against my credit reports as a result of this notice that I will be forced to take appropriate action against your agency, your client and any person employed by either who violates this federal law, with civil and/or criminal charges. Do you remember ever having a delinquent debt with a phone company? With all the merging and buying these days, it may be tough to remember. If this indeed not your account, you need to file a police report. Then you must sign a fraud affidavit. I'm not sure if you have an attorney who could write one up. After filing your police report, request the company to send you a fraud affidavit for you to sign. Gage their response on this. Usually fraud affidavits will make you sign your name three times, state you never had the account, and then you get it notarized. When there is a police report plus a fraud affidavit, they don't have much of a leg to stand on.

The bill was likely originally owed to a company that was bought out by Sprint. With all the mergers of phone companies over the past decade or so, the "big" ones are now trying to collect on old accounts receivable. If there actually is a debt, chances are that it is past the statute of limitations by this point, and past the reporting period allowed under the FCRA. If they continue to hassle you, send them a cease and desist letter. Just google "cease and desist letter collection agency" and you'll find some good ones with instructions regarding the prodecural aspects. Best regards!
