We purchased our home in Jan. 2004. We spent several days debating as we knew that there was an issue of bugs. We agreed that in order for us to purchase this home we had stipilations that we wanted written into the sales contract
Home Bug Free-free of black moths,ant, flies and etc. is what this persons put into the contract.
3 days before moving in the realtor/broker called and told me that he didn't have time to have the carpets cleaned and that I need to hire someone to take care of that. He also stated that he got the bug problem taken care of because after he removed the base of the cabinets (a portion of cabinets) he found dog food-lots of it and that the bug problem just needs to gestate out, don't worry. He never bothered to check the rest of the kitchen.
After two weeks we had to move the kitchen back out because the black moths/larvae were so bad. Then came the carpet beetles, ciargartte beetles.
Agent/Broker/Previous owner agreed that they would hire a pest control service for three months in order to take care of the issue.
After 4 months, we were livid. I was cleaning my kitchen 10-15 times a day because the bugs were so bad. I was calling him and telling him that something needs to be done as we had a legal binding agreement. We sent documentation- pictures and etc. That was after we had opened a small whole at the gas line and food more dog food, and bugs were crawling up walls and across floors.
Agent/Broker- States we just want our kitchen remodeled!
It took almost a month before he came back at us with- "we'll tent the house and that should take care of it" We moved the kitchen out again ( this was the 6 time), We packed up the whole house because thats what you need to do in order to have the house tented. We moved into a hotel for 5 days. Hubby in one part of CA and Me and the kids in other. those expense haven't been reimbursed.
Fumigation company- Used 200 pounds of gas, normally they use 20 pounds.
Within a month- the bugs were back. Called again and he went off saying how we just want our kitchen remodeled and he's done everything he can. No, he hasn't we signed an agreement and he represented both of us because we were not allowed to have our own agent. (exclusive sale/agent).
Agent/Broker was told by the fumigatin company, our pest control service and the one that he hired that in order for the bug issue to be resovled the food source has to be removed.
He did nothing.
By January 2005 we had to take out a loan in order to provide a healthy enviroment for our children.
What we discovered when we started the remodeled on the kitchen-The whole enitre base of the cabinets throughout the kitchen were filled to the top with dog food and the beetles were feeding/breeding. A total of 55 pounds of dog food was removed from the kitchen/and wall.
Come to find out after doing some investation in the courts, this man has several cases and the biggest one- Ripping someone off when it came to purchasing real esate property.
Have filed with several different agencies along with a suit in civil. We want his commission back as he did not represent us in the manner agreed.
