I was trying to sell some things on Craigslist to get some money for my brother back east. I am in phoenix Arizona and he is in lakeland Florida. Upon getting a check from an individual I deposited it into my chase account. 

From that I waited until the funds cleared then I submitted funds forward. 3 days after the posting the check was committed as a stollen check and that amount was taken back out of my account. I went to chase twice to review and fix this mess but to no avail chase will not refund or remburse myself on this. 

I do feel that we put our trust in a bank to show when issues such as finances are posted and when things clear. From there we entrust to go forward. The amount was well over $1000.00

I would have waited till the check "absolutely" cleared. Specially if it's for a $1000 or more. Secondly, when dealing with those you don't know personally, I would have made them use paypal or some other form of electronic payment. At least with that, you would have been guaranteed the funds.

 

The Banks are doing what they are required to do, as Stacey said, and they have to release the funds in a timely manner in accordance to Bank regulations. They, Chase or any other Bank or Credit Union, operates the same way.

Unfortunatly you fell for a very common scam.  While it is not limited to just Craigslist, there is a reason why that site has the nickname "Scams"list. 

Also, unfortunatly you are responsible for any check that gets deposited into your account.  What this means is that if the check comes back bad you are responsible to "make it right".  The bank is under no obligation, nor will any bank, actually cover this loss.  Your only recourse would be to go after the person who gave you the check.  However, it is likely that in addition to the fake check, they gave you a fake name and most likely a PO box to send the item to.  All of which will make tracing that person next to impossible. 

Now, as for the check "clearing".  Realize that banks have to follow Federal Regulations that specify how long they can hold the funds before they are released to you.  The regulation is known as Regulation CC or the Expedited Funds Availablity Act.  Depeding on the type of check, amount, and location the check was from will determine this.  As it could be anywhere from about 1 to 11 business days.  The big "gottcha" is that even if the funds are made available to you, that does NOT mean that the check actually "cleared".  This is how the scammers get you...they hope that the bank releases the funds before you realize you got scammed.

YOU took a CHECK from an unknown individual.  Common scam! The Bank is only doing their part to reclaim the money that YOU used with a "stollen" check. You will not be "remburse" because YOU put that check into YOUR account.  END of story.
