This company actually has two "faces" if you will. In your case, you have been contacted by the "enforcement" division of the company. The only way you ended up on the receiving end of their business is that the custodial parent has signed a contract with the company, usually for one year. The details of the contract spell out exactly what percentage of unpaid child support the company will recieve. In order to even consider your case, they have to have a copy of the court order and an affadavit of arrears signed by her. Penalties and interest set forth in the jurisdiction of the court order would still, arguably, apply. To complicate matters, many states will not share any information about your payments with this company. For some reason, they are jealous of their power to enforce court ordered child support.Even though they seldom seem to be able to keep up with the demand. I know this is frustrating, and I know that the people you are dealing with are unpleasant. Remember that they come into daily contact with people who are so vile that they can not or will not bring themselves to support their own flesh and blood. The best way to resolve this is to reconcile their statement of arrears with your own pay stubs and you need to order the most recent statement of arrears from the appropriate agency. Be sure to make copies and keep originals. You may want to consider a modification through the court in order to "re-set the clock" in a more formal and binding way. If you are curent with your child support obligations, please understand that the actions of the majority of non-custodial parents have placed you in a difficult position. My husband pays child support also. They have screwed up his account so many times! This is in Florida. Nothing but lazy ghetto refugees work there! He has even had a ticket for driving on a suspended liscence because of a woman at the child support office not doing her job and submitting the proper paperwork when his balance due was paid in full. I hope that you get your money back! Maybe a signed, notarized letter from your ex would help your case? I would also copy everything over again and send it by certified mail, return receipt requested and cc(send a copy to, and state this on the bottom of your cover letter) to your state legislators. It might cost you a few bucks, but it will get their attention. Good luck, and congratulations on your upcoming wedding!
