This customer purchased a vehicle from us prior to final lender approval. A Bailment Agreement was signed (subject to credit approval form) clearly stating that the purchase was contingent upon final approval by lenders, and that if approval was not obtained then the customer would have to return the vehicle upon notice and could be liable for any depreciaton or usage charges, and get their trade-in back.
After several days of trying to secure an approval, our finance department was unable to do so and the customer was informed that they would have to return the vehicle per the original agreement. After several days of phone calls trying to reach the customer and get our vehicle back, the customer abrogated their agreement to the original terms by stating they would not bring the vehicle back any time soon. In an effort to minimize frustration for all involved, we offered to hire a driver and have the trade-in brought back to them and to retrieve our car. This was done completely at the dealership's expense, and at the convenience of the customer. Their trade-in was driven by an elderly gentleman who often drives for dealerships. The vehicle left our lot in running order (barely - it was in a very severe state of disrepair when traded in) and with all the equipment it had when on it when it was traded in. The trade-in was brought back and the swap was made. After several hours had gone by, the customer called stating that their vehicle was malfunctioning and that it had been tampered with. In an effort to provide good customer service we offered to have it picked up by a towing service and checked out (again at our expense). Upon being towed in, it was clear that the vehicle had not been tampered with in any way, and was simply functioning poorly as a result of the age and condition that it was in (probably the reason they wanted to trade it in the first place.)
The bottom line here is that we went above and beyond trying to secure financing for a vehicle purchase, and when that was no longer possible we went above and beyond again by delivering the customer's vehicle back to them, and by having it towed in free of charge to get looked at. It is unfortunate that the financing didn't work out and that their vehicle was in poor condition.
Chris Myers has been retailing new and pre-owned automobiles in Daphne, AL since the early 1980s and is a reputable fixture in the community. In NO WAY WAS THIS CUSTOMER'S VEHICLE TAMPERED WITH AT ANY TIME.
