The reason I am writing is over a false advertising issue we have with a local Circuit City store in the Hamburg area of Lexington, KY. My wife and I were shopping there this past weekend (3/1/08), just out for our 24th anniversary. We came across what appeared to be a good deal on a video camera. Long story short, they were using a higher end camera to display for a cheaper cameras price, this was very apparent. They were caught red handed and they still refuse to own up to it and sell the camera for the price displayed. My other concern is how many customers were ripped off with this scam?

We have already purchased a much better camcorder for around the same price as they were asking for the cheap camcorder they were selling. If the cheaper camcorder had been displayed for the $229. price I would have not been interested in the camera, I don't believe anyone would, however they had a higher end model same manufacture on display with the cheaper cameras price tag. Now they knew and I can prove it! That wasn't enough, when I asked the supervisor how that happened, he said that maybe a customer switched price tags on the cameras, the thing is that they cheaper camera was not on display at all, so where would this customer get the tag? He said that it should have been on display but it wasn't. Still does not answer the question!! Then he tells me that hypothetically there could have been both tags at the same display even though there wasn't.

This scam is called bait and switch, i.e. A customer comes in and looks at a camera, its a nice camera with all the features.. The price advertised is for a cheaper camera but the customer does not know this. The customer says I would like to buy this camera and the sales associates sales him the cheaper camera, remember the customer thinks he is buying the better nicer camera he looked at on display and played with and decided he wanted. Now the customer will get the camera home and be shocked to find that the camera they just bought is not the camera they looked at. Now you have a unhappy customer.

This senerio almost happened to me, except I caught it and the sales associate grabbed the actual camera that was on display, this camera cost $599., big difference from $229.. But the supervisor still tried to sell me the cheaper camera for that $229. price, he assured me that they were exactly the same except for the $599. camera was HD and the other was not. So I have the specs here on the 2 cameras, you decide if they are the same!!

Those little cards that have the specs and the price are pretty self explanatory. They have a few things on there including the name and model of the camera and some info. It is possible that the wrong card was put on the camera you were looking at and as another poster mentioned it is possible because of us being humans and all. At the end of the day the answer to your problem from any retail manager I've worked with would have been "I'm sorry for any inconvenience, but these are two different cameras. You can have the MX10 for this price or the MXH10 for that price." Its also important to choose the accusation wisely as you make one. Throwing around things like "bait and switch" when that is not what is going on tends to toss any credibility out the window while dealing with higher ups. Explain your situation without telling corporate offices what low life con artists their store associates are and you may get some where with a complaint. Same with organizations like the attorney generals' office for you state or the BBB, they won't listen when you call and start shouting B&S. There are a lot of FTC regulations you could look through and see if something fits your case before just shouting the most well known. And to the gentleman who thinks Circuit City has a problem giving credit to minorities, that simply wrong, sir. The information is fed into the computer, an alogorhythm does its things on a computer in another building, probably in another state, and gives back a yes or no answer. It takes as little as 60 seconds when the computer is running smooth and never does the computer take a picture of you to deny you based on race. If you had a problem with the card process, CHASE handles those cards and if you want to accuse someone of racism they may be a good place to start, right after you take a good long look at the comment you made to make sure you don't have a problem with race.

If I had been the sales clerk I would have realized that the tag was wrong and apologized to the customer. Obviously the customer knew that the tag was wrong and tried to take advantage of the store's mistake. This would have been a good deal but it is dishonest. I don't think that I would enjoy the camera afterwards. People think that since a store is part of a natioinal chain it has unlimited funds or buys products for 10 cents on the dollar. This is not true and no store can afford to take a two or three hundred dollar hit because of a clerk's mistake. I don't think a lawsuit or cunsumer affairs complaint will hold much water. There was an honest mistake made and if I had identified the mistake I would have informed the clerk. That would have been the honest thing to do.

By now you'd think ol' Mark would've posted the results of his "lawsuit". I would think he would've jumped at the chance to post it. But, alas there was no lawsuit was there, Mark. No, there never are lawsuits really, mainly because those who threaten them wouldn't dare embarrass themselves in front of a lawyer much less a court of law. We only have one side of the story, which is really a "message fragment". And not much of one.

Anyway, the fact is, the tag was not right & you knew it. I bet you just asked the associate to sell you that (I've seen customers just pick the tag up and take it to someone so as to avoid them even seeing the camera). Look, I know you were on your honeymoon or whatever, but the fact that you claim you knew it was the wrong camcorder and then were proven right just goes to show that Circuit City is run by, what... PEOPLE! People make mistakes. The manager made a mistake, they gave you your money back, you got a "better" camcorder for the lower price and are never shopping again. End the story there. Not like they got into your account and stole your identity, whoever put the tag there made a simple mistake. And just like the other person said, there was one letter missing. What people fail to realize is this is a business, and if you were running a business and put a mistake up, you wouldn't honor it. It wasn't false advertising because the tage read the model of a different camcorder. So, as far as your lawsuit goes...Good Luck. You'll need it.

Listen mmy, I did include the model number of the other camera! Read the report and you will see that it is clearly stated in the report!!! Also what you don't understand is that the tag listed for $229. had the $599. model number on it! So mistake or not this camera should have been sold for that price, and nobody will make me believe different!! So read and get the facts straight before you come in here and start blowing off about something you don't know crap about!!!

Mark, you are right... this situation is not funny at all... but unfortunately, its very possible. Coming from a retailer that has had similar issues to what you've experienced. This probably one of those mistakes made by the team which is responsible for setting the sales promotion. I've been in several stores and have seen this happen, especially with model numbers that are so much alike. I think the problem lies within the store and management should focus on the training their teams to execute on a more accurate level. Unfortunately, no retailer has been able to perfect this. (not yet at least) After reading your statement I do believe it was a mistake made by the stores associate. But I also wonder why you failed to mention the model number of the second camera in your statement. Would it be to obvious that it could have possible been a mistake.

First off, I highly doubt that we were using a higher end camcorder to represent the camcorder from the fact tag .. I chalk that up to a stupid, somewhat common mistake You did a good job copy/pasting the descriptions of the 2 camcorders from our website, but what you failed to mention was the fact that the HD camcorder's name is 1 letter off from the SD camcorder's name .. The Samsung SC-MX10 ($229.99) and the Samsung SC-HMX10 ($599.99) .. They even look somewhat similar, main difference being the lens-end and a very slight differentiation in color. Lol .. you also said that this was an example of bait-and-switch. "In retail sales, a bait and switch is a form of fraud in which the party putting forth the fraud lures in customers by advertising a product or service at an unprofitably low price, then reveals to potential customers that the advertised good is not available but that a substitute is" (Wikipedia: Bait and Switch article) So, in your case .. if it had been bait-and-switch, it would've been like this: The add actually features the HD model of the camcorder (instead of the SD model) @ the same low price as its SD counterpart..You come in to purchase the HD camcorder at this unbeatable price, but we inform you that it's not in stock..Then we offer you X brand camcorder at the same unbeatable price, but the REGULAR PRICED $229 camcorder doesn't have all the great, fun, fancy features of the SALE camcorder (obviously since the HD camcorders regular price is $799.99) And seriously, I have never in my life sold a customer a digital cam or a camcorder without them wanting to see the box first. If you look at the features on the lower end camcorders box you'll instantly be alerted to the fact they (DUH) they don't come close to each other. Also, you show us a product your interested in, we look at the fact tag, we grab the product listed on the tag .. we don't make sure it's in front of the correct product first, we assume that whichever associate put the sales tags out put the tags in the right place .. 99% of the time we don't notice it, until one of you (customers) points it out Perfect example.....In my store, a customer pointed a camera out (Sony DSC-S730), he asked about the price...I looked at the tag (Samsung S730) .. the items having the following item numbers respectively SON DSCS730 and SOE S730 .. I think the prices were Sony: $349 and Samsung: $119, but I could be wrong our sites down for maintenance and I can't remember quite honestly. Either way, the item numbers are much further differentiated from each other verses the Samsung's (SAM SCMX10 / SAM SCHMX10) but we still made a stupid mistake .. And I would definitely assume that the associate would grab the actual display camera and explain the price and mistake and show you the actual sale model (assuming it's planogramed to be on display, or if not plano'd is on display per manager approval) .. What you could prove, is that you caught one of our stupid little clerical style mistakes red-handed. lol. Call it a "in-store typo."
