Complaint Review: Clark County Public Guardians Office - las vegas Nevada

 My name is Morgan Heberling, my brother is Jason Heberling. We are currently in litigation over the guardianship of my mother Sheila Heberling against the public guardian Kathleen Buchanan, a greedy man hater, who freely abuses her power of public guardian.

Now our mother Sheila Heberling is potentially to become a ward of the state. And we have no problem with that. Because she recently had a brain tumor, the size of a lemon, removed from her head and following that surgery has colon cancer and surgery for that. Now following the brain surgery our mother, who had just received her masters degree, was not the same person her raised us. The mother we knew was a bustling english women who was always up with the sun and worked full time for welfare while going to school for her masters degree. Following the surgery of the brain tumor our mother turned in a vegetable who would sneak around the house when we were asleep defecating everywhere. 

My brother and i only want the best care for our mother . with both of us being mentally disabled, our father was a part of operation redwing hydrogen bomb tests in the bikini atoll, in the 50's, we feel that we would not be suitable to be responsible for her care as we can barely take care of ourselves. So we felt it was in our mother's best interest that the guardians office take care of her. However, this is when it gets really screwy. 

OK, to keep this as short as possible i will be brief in the explanation...     here goes, my dad paid off our family home, put  new roof on and fence around it before he died. his reason was for non of us ever to be homeless. he wasn't very legal savvy so there was so estate or what ever drawn up. we have a large property with much work needed to be done on  a regular basis, painting, tree trimming yard work, etc. so my brother about 15 years ago at our mom's request moved back in to our family home to take care of it, did i mention our family has lived in this house for over 45 years... anyhoo i moves back to help my brother with the property upkeep 10 years ago.

     Prior to us moving back our mother, who has a serious compulsive spending disorder, mortgaged the house 4 times, against our wishes, and spent all the money on frivilous "home improvements" done by unlisvensed contractors... here's a widow with lots of money and no men around, or her for that matter because she was working full time and going to school. so yes, she got took and lost a lot of money with substandard work being done. in addition to that, she used the money from the mortgages to pay off her astranomical credit card bills and fund her champagne tastes.

     as a side note, the way the loans were set up falls under nevada law for predatory lending and my brother and have been butting heads with bank of america and have so far got one of the loans squashed. but the home is still upside in loans and has no equ ity...

     stay with me, here comes the big finish...

     OK, what all this boils down to is my mom makes enough with her retirement to cover her care through being a ward of the state. when my mom abandoned the house to move colorado with our cousin, she took all her belongings, hopped on a plane just 2weeks after brainsurgery, that is very bad, and left me and my bro to fight b of a for the house.

     when she came back, which we never thought was going to happen, she had only a pack of diapers and the clothes on her back.

     now here comes kathleen buchanan with thwe guardians office wanting to take our home with everything in it. even though the only thing in it are me and my brothers possessions. well because there is no equity in the home we asked the judge if we could stay in the home keep fending off b of a and keep working towards getting the last loan squashed. he was cool with that.

     sorry, i'm really struggling to finish this...  

     but when we leave the court kathleen buchanan says to me and my brother, thats not going to be how she's goimg to do it and she intends to take our home, making us homeless, and take everything in our home,even though its me and my brother's possessions. she said that everything in our mother's home belongs to our mother and she is going to take it and sell it to pay for our mother's care, even though the cost of our mother's care is covered by her monthly retirement income.

     so it would seem to me that the only reason kathleen buchananis being such a d**k about everything is because she is greedy and wants to line her own pockets. and for some reason, in her mind there is a bunch of money to be got from the loans our mom took out. but there is not any money or property to get money from because our mom blew all the money she got from the mortgages becauase our mom spent it ALL on unliscenced contractors, credit cards, shoes and clothes, and paying off previous loans with new loans. 

     so, our mom has no money in her estate, we are trying to avoid being homeless, and kathleen buchanan thinks we're lying and there is all this money to be got... but that is not the case.

     all we want is good care for our mom and to not be homeles, but kathleen buchanan is being a total greedy d**k about this and sending us legal papers with all these allegations of abuse and criminal activity that is not true and were not filed with the court trying scare us to back down and abandon our family's home of over 45 years. 

     is this right, or within the law?
