Early in 2016, Coldwell Banker Prime Properties listed 154 Van Tassell Rd, Raven Rock Development, Lee NY as a four bedroom duplex.  

In reality, the occupancy permit for the duplex noted it was a two bedroom duplex.  The other rooms were not authorized as bedrooms, and were noted as illegal use by the local code enforcement officer.   The other bedrooms did not have the required smoke detectors wired to the system, and the basement bedroom, still advertised as of 8/20/16, fails to have adequate secondary egress, making it ill suited for a bedroom.  The codes officer noted that the basement build out was done illegally, and without inspections and permits.

 

Additionally, the broker failed to disclose several lawsuits against the developer and builder, and the fact that if they lost the suits, the houses become unmarketable.

 

The developer and builder did indeed lose the lawsuit, as the units did not have appropriate fire protection, fire walls, septic systems and other inconsistencies with the state and national building codes.  

 

Coldwell Banker Prime Properties continues to advertise the property for sale without adequate warning to potential buyers.  They were reported to the State of New York, and agreed to alter advertising for the units..........it is still deceptive, noting a  basement bedroom (ilegal) and not noting the deficiencies of the unit.
