After deciding to live with hail damage to our vehicle, we sent an insurance check to Credit Acceptance Corporation to be applied directly to the principle balance. The payment was input incorrectly and our account was reported to the credit reporting companies as in collection. We have never been late for one payment. Credit Acceptance refused to correct. We began fighting this action in October, 1003. Believing all was cleared, we applied for a loan through an auto dealer and were told, 'No one can help you.'

Credit Acceptance Corporation did not clear this up until after we paid the the loan in full. The loan was paid approximately 30 months early! Numerous contacts were made to them by myself and the local automobile dealer with whom they contracted.

We now have MULTIPLE NEGATIVE REPORTS on file in several local and national financial companies.

I too had always payed on time except for one instance where my bank account was debited incorrectly from True-pay (company used by CAC to pull my payment directly out of my checking acct). I had moved from one state to another and changed banks. I called Truepay and gave them the information but they failed to pull my money out of the correct acct. In all the busy-ness that comes with moving, I didnt realize this had not been done correctly for probably 3 weeks so it was deffinatly late, not on my account though. I called Truepay and got the issue handled and then called Credit Acceptance to explain the situation. They were very nice but couldnt change the history. The individual I talked to did tell me that I should contact the credit bureaus and dispute the reporting of the late payment and it should get taken care of that way. I did do this and although it took me about a month, the late payment was taken out of my history and it became perfect again. It was actually a very easy process that I did all online. Equifax and Transunion and Experian are the three bureaus that are used and you can access all these sites online. Good Luck!!

Contact and Letter Received, no offer of compensation

On the date of 4/15/2004, after more faxes to Credit Acceptance Corporation and to some of their Dealer 'Partners', I received a telephone call from Mr. Steve King from Credit Acceptance Corporation. He stated a letter would be mailed on that date, April 15, 2004, via overnight delivery, stating our account was paid in full with no late payments. Enclosed would be a separate letter to present to financial institutions, should we need to seek financing in the future. Since Mr. King did not identify his position nor department within CAC, I called the Corporate office and inquired as to who he was. I was advised by Amber that Mr. King is a Supervisor in the Corporate Legal Department. The Overnight Delivery was not received on 4/16/04, but on April 19, 2004. The form letters received indicate, without a doubt, that Credit Acceptance Corporation did, in fact, provide incorrect information to the credit bureaus. A cover letter apologizes for any inconvenience. There has been no offer of compensation for expenses incurred due to this, nor any offer of compensatory damages.

PRESIDENT KEITH McCLUSKEY IGNORES FAXES

Today, April 14, 2004, I have faxed Mr. Keith McCluskey 3 (three) separate times and have called 3 times. He, as President of Credit Acceptance Corporation, has not responded. The telephone calls were also unsuccessful. One was cut off; and, 2 were responded to with 'I'm sorry he is not available/not answering his line'. Please note, all three were being asked who was calling. Full copies were sentas follows: to him at his fax number; one sent in care of the Corporate Legal Department; one sent in care of the Legal Department (yes, there are two legal departments); and one sent in care of the Customer Service Manager It is now 5:00 pm EST and there still has been no response from CREDIT ACCEPTANCE CORPORATION. I have submitted a copy of the Fax to be attached as a photo.

Received a letter from Credit Acceptance Corporation on March 29, 2004

Please note the following dates: AUGUST 22, 2003 a check in the amount of $3,996.22 was sent by me to Credit Acceptance Corporation with instructions to apply towards principle balance. OCTOBER 22, 2003 we were made aware of the false reporting on our credit report by Credit Acceptance Corporation. OCTOBER 23, 2003, phone calls and written requests and formal disputes began and continued, culminating in a faxed letter from us dated JANUARY 9, 2004, addressed to the President, Mr. Keith P. McCluskey, the Customer Service Manager and the Legal Department. It was faxed to the following number: 702-990-2728. Following that letter, a correction was made to our Credit Report. Unfortunately, we had been turned down by numerous financial institutions, locally and nationally, for a much needed loan. (NOTE: The loan was PAID IN FULL on the date of DECEMBER 16, 2003) However, because of the false reporting by Credit Acceptance Corporation to the credit reporting companies, we are now on negative file with those companies for years to come. On MARCH 29, 2004, we received a letter from Credit Acceptance Corporation dated and postmarked MARCH 25, 2004, acknowledging the Credit Report Dispute. It states '...This letter confirms our receipt of your recent credit report dispute. We will conduct our investigation and within 30 days of this acknowledgement we will contact you with the results...' This letter is from Compliance Analyst, LaShumbra D. Singleton (no signature affixed).
