Short of taking them to court and somehow showing that the bank is the one that misled you in the deal (they didn't, all they do is lend money) you will be responsible for the balance after auction.

this is a direct response to suzanne who apparently has/does work for a lending institution, if you had paid a little closer attention i think you would have focused on the fact of that they were saying all the harassing calls kept coming even after she said they could have the car back also she said bank would "fix the problem because they dont finance cars like this" dont get me wrong, i agree it is a consumers responsibility to check out a car thoroughly before buying but also stated they were ill so maybe did not pay close enough attention. it also became the repo/banks when they said they would not pick the car up! in these trying times it seems the banks/lenders are getting more and more guido with their practices. one last thing can you tell me if its OUR responsibility to BAIL OUT these banks I DONT THINK SO!

I was dealers a finance manager for 9 years at a dealership that was not in the practice of selling junk or not disclosing the terms of the deal. I did hundreds of loans with crescent bank and many happy repeat customers. Whats the common thread here is the dealerships failure to disclose to the customer that crescent bank is a last resort for the dealer also. Meaning the other sub prime lenders have turned them down and Crescent will finance it and no one else.This would require a downpayment of at least 20 percent down and would be a simple interest loan at a high interest rate. I would then explain that this is a vehicle that you can reestablish your credit with but you need to pay ON TIME for at least two years.Usually because they have zero positive credit history and would not have built any equity in the vehicle. If they agreed and actually paid on time and took care of the car it was no problem and I traded them and refinanced them at a lower interest rate and they continued to rebuild thier credit. Late payments reflect a negitive history and falling on hard times and the car breaking down or having mold in your case. None of that is the banks responsibility. Its yours and the dealers. You say you bought the car in 06 and rightyou to the dealer and insisted they fix it, replace it or take it back. Which by the way is grounds for the bank to make them buy back the loan if they refused. You purchased your car in 06 and three years later your wanting the bank to come get it because of the condition of the car. Thats absurd. You could have avoided a bankruptsy and made the dealer liable. This sounds more like a case of you have a car you don't want anymore and don't mind that you have further ruined your credit for the next ten years. So you will need to pay cash for future purchases and you won't have the bank to blame or hassle you. Banks finance cars they dont repair them and they lose money when they have to repo it and sell it at a wholesale auction nobody wins in that situation.

I would like to start off by addressing your complaint that they call you at illegal times of 8:00am. http://en.wikipedia.org/wiki/Fair_Debt_Collection_Practices_Act According to the FDCPA, Hours for phone contact: contacting consumers by telephone outside of the hours of 8:00 a.m. to 9:00 p.m. local time is considered "harasing" Now, on to the other problem I have with your complaint. You stated that the car had problems with it at the time of purchase, but Crescent Bank did not inspect the vehicle YOU chose to purchase. Crescent Bank simply gave you the MEANS to purchase that vehicle through an auto-loan. We are not responsible for the vehicle that you choose. If you have a problem with it, it should be brought to the dealerships attention, not the finance company.
