About a year ago my company engaged DaVinci to provide a local number for my new company. Turns out they could only supply a long-distance numbers as the buy phone numbers in bulk from local providers before checking they're actually local numbers.

A long-distance number was going to kill my business and so I informed them that if they could not provide me with a local number they were in Breach of Contract and that I was not interested in using their services. Furthermore, no further billings were going to be accepted, (we never did end up using the phone number or mailing address they provided).

I'm not sure what part of no further billings were going to be accepted and that they were in Breach of Contract they didn't understand but I've recently found out that they have continued to bill my wife's credit card for services even after my instructions.

My wife had to cancel her credit card in order to stop their billings.

My company has reached out to the owner as well as two other senior individuals in the company. They are refusing to issue money back and now are not returning calls / emails.

We have been forced to contact the Advertising Council here in Canada to report their behaviour and have also discussed our options with the Federal Trade Commission Division of Advertising Practices in the U.S. 

We have also contact local media firms here in Canada, (Marketplace and CityTV), to start the ball rolling on providing as many people as we can information on the practices of this company.

The Customer is never right at Davinci!

Anyone considering using this company should pay attention to the trouble we've been having with them. This should be a lesson to all about what Davinci thinks about customer service.

True - We did sign a Contract with Davinci for a local number for my business.

True - A local number was not provided as advertised, (they have actually admitted this in print) and they now blame the customer for this point. Perhaps Davinci should do their due diligence before saying they can provide a service when, in fact, they cannot. So the warning here is that Davinci does not care whether or not a phone line is local or not, just blame the customer and / or the provider they bought the number from.

True - I indicated that because they did not provide what they advertise I held them in Breach of their Contract and expect no further billings from them.

True - Davinci kept billing my wife's credit card after clearly being told not to and that we would not accept these charges.

We have since been contacted by "Marketplace", (a television show here in Canada), who have expressed an interest in speaking with us further about our experiences with this company. 

Additionally, we have spoken with a representative in the Government of Canada, Competition Bureau - Misleading Advertising and Labelling department. We believe Davinci Virtual Offices have contravened the Competition Act.

In Canada the misleading advertising and labelling provisions are enforced by the Competition Bureau prohibit making any deceptive representations for the purpose of promoting a product or a business interest, and encourage the provision of sufficient information to allow consumers to make informed choices. 

We will provide everyone here with regular updates on how this is progressing...

 To Whom It May Concern:

This client signed a proposal on 4/3/2012, stating that they agreed to our terms of service. They requested a local number, which we provided. They also turned in a notarized government postal form 1583 along with 2 forms of ID. Davinci Virtual provided all services per the contract. Unfortuantely, the client's direct phone provider charged long distance fees, which is outside of Davinci's control, and has nothing to do with Davinci's level or service or contract terms. Although this was not Davinci's fault, we offered to provide a full refund as well as immediate cancellation of the phone service. This email was sent to the client on 4/20/2012, which we received no further response from the client.

I am more than happy to cancel your phone services immediately and refund back all charges associated with this service. The location services will stay active. I hope this solution resolves your issue.

I was very clear that the location services would stay active and to let me know if they had any further questions. Since this email was sent, the credit card on file also declined twice, which was resolved by the client both times and updated payment was made. Then, in April 2013 we were finally notified that they apparently did not want to move forward with the location services a year ago. We have since cancelled the account immediately, but we are not able to issue a refund for an entire year where services were provided.
