On May 17, 2003, under high pressure, the manager, Adrian Crabtree and salesman, Rick Blakiston convinced me to drive off in a 2003 Mitsubishi Outlander with my personal check that they agreed not to cash until my personal injury settlement was deposited. They requested a statement from my attorney that verified I indeed had a settlement pending and it was faxed to them.

The beginning of September it was clear that I was not going to recover the amount of money that I expected because of a subrogation agreement built into my health care insurance. I contacted Adrian Crabtree and made arrangements to meet with him on September 16, 2003 to trade in the Outlander and get a more affordable car. I drove several on the used car lot and chose a 2000 Honda Civic.

Adraian Crabtree assured me that I would be totally and completely even with Dennis Autopoint with this deal and I would not owe them another dime. (I asked about 5 times) They requested the title for my trade-in and $13,000, both which was given to them.

The first week in November my Honda Civic was suddenly missing from my drive way. Some of my personal effects thrown under a bush, some stolen, and they opened our garage door to have enough room to steal the car! The police discovered the car at Dennis Autopoint.

Aaron Masterson, the manager, now claims he wants more money or Dennis Autpoint will charge me with writing a bad check because they tried to cash the $26,000 from the original deal knowing full well it was not available.

They also contend that they did not sign the trade-in and $13,000 agreement, only we did, therefore they do not have to give us title to the Honda!!!

We gave them title to the Outlander and the $13,000 they asked for! Now they have my Outlander trade-in, my $13,000 and the Honda I have paid for in full and I cannot get a court date for over a year!!!

I am completely without transportation to my weekly doctor appointments and physical therapy. My son no longer has transportation to and from school. All documents, in!

cluding the purchase order outlining the trade in and the cash needed, the cancelled check, my title for my trade-in that is now in their name are all available to you. It is completely unbelievable to me that they could accept my trade-in and my check for $13,000, send me off in my Honda for nearly 2 months then decide they did not agree to the deal by not signing the purchase contract! If they were not in agreement why did they accept my trade in and my money????
