Ok heres how it went.

I wanted to get out on my own and move out of my parents house.I have good credit but no enough to get an apartment in a good area without having someone co-sign.I did not want my parents to co-sign,after all I am trying to be on my own and build responsibility and credit.

I checked out about 7 apartments in my area close to my parents house and work.None of them would accept me without 6 months rental history and paying rent at my parents house for 2 years wasnt good enough for them.I then found Desert Start apartments.I was approved right away.I signed a 7 month lease and was on my way to my new apartment.

I had some friends move my stuff in to my apartment while I went to school and work .

A few days or so after I moved in I had a police officer at my door saying theres been robberies and that someone was caught breaking into my apartment.

About 30 feet from my apartment is the back of a liquor store and lots of bums and panhandlers drinking beer live under a tree there and would hassle me for change every night that I would come home at early times in the morning.

I want to clearly state that my line of work and school is nothing but computers. I network ,I build PC's and I even design simple logos for websites. I love computers with a passion. I had about 4 computers in my apartment at the time. All very expensive web servers and dual processors and SCSI devices. Anyone who knows computers knows that aint cheap to run those kind of setups.

After that incident with the police I had someone staying at my house whenever I wasnt there to watch over. Every person that watched over my house (about 6 or 7 different friends at different times) said that about 10 or 15 people came to my door daily asking to buy crack cocaine or methamphetamine or asking for some wierd guy/girl. I even had an undercover policeman push his way in and knock my girlfriend to the floor asking if we can score any crack, when we pushed him outside and started dialing 911 he showed us his badge and identification.

All this prompted me to move all of my computers back to my parents house and my valuables out of my apt. and tried to work extra hours and study longer at school so I didnt have to deal with the pressures of my "ghetto" apartment. I payed my friends money so they didn't mind.

A week or so after that I got a notice on my door saying that I had registrants living here that wasn't on the lease and I had 48 hours to contact the office or I would be evicted. I was furious when I saw this. I went down to the office and spoke with the management and they were furious to see me. Apparantly I had too much traffic at my apt. and I had police there on 2 occasions and it was all reported. Also It was written down that I had some convicted felon knocking at my door so thats the reason they were watching me.

I told them my situation and I even had pictures of the trancients that lived a few feet away from my apartment.

They didn't care, they wanted me to get all of my friends down here and have them put on the lease and pay a 20$ fee for each person.

I declined there invitation to pay 140 dollers extra to have them put on the lease and went about my daily life.

Next thing you know I was bieng sued.

I am not going to get into the court story but the judge was 100% in my favor even though they had 2 witnesses and and attorney. On my end it was just me and my mom. Anyway I beat them in court and the judge waived all penatlies and I had to pay no extra fees. I was happy when this happened. I was able to move out without paying a broken lease fee and having it on my credit.

When I got back to pay my small fee for living there the manager who testified against us in court was so mad she was shaking in her shoes. She couldn't even look me in the eye. It was justice at its best. I then moved out with no problems and continued on with my career and life,living back at my parents house.

About 2 weeks had passed and I get this thing in the mail ; a handwritten paper by one of the office ladies, STATEMENT OF DEPOSIT ACCOUNT

an in this paper is highlighted with pink highliter ;

ADDITIONAL CHARGES

-lease break 449.00

-subletting for 500.00

-rental concession 189.00 TOTAL = 1138.00

Subbletting for rental consession is all one sentance, but they got separate charges next to "subletting for" and "rental concession",strange....

Nowhere in this "statement of deposit account" does it say I have to pay or I owe them anything. Besides,the judge ruled in my favor and I have court stamped approved papers to prove it. And the reciepts proving I payed them.

Now I am constantly bieng harrased by TCS (Thunderbird Collection Systems) and I still haven't got any court order or judgements against me from TCS or Desert Star.

They turned me into collections without even letting me know that I supposedly owe them anything.

TCS then tried to garnish my wages but my place of work knows they can get into big big trouble for doing that without a court order and told them "No such employee" .

My mom was diagnosed with cancer about 2 years ago. She is still going through the recovery process from her Mastectomy (removal of breast due to breast cancer). TCS even calls her phoneline to harass her directly after they call my phoneline to harass me. My mom has told them very nicely to call my line and not to call hers, but they still harass her. My mom is recovering from breast cancer, theres no need to harass her especially after she told them numerous times to leave her alone.

TSC or Desert Star has nothing on me, Bigelow Management Inc. is a corrupt bussiness. I now have proof from other individuals who went through the same sort of stuff with Desert Star and won in court. They accepted me because they thought that I was an easy prey to kick me out and get triple there money for letting me stay there for little over a month.

Desert Star should have left me alone when I won in court. I have proof with all the court orders and reciepts so I don't even answer the phone when Thunderbird Collections harrases me. They have no right and should look it up legally before they go collecting and harrassing on someone who beat the pursuers in court and payed there fines legally.

I think Desert Star should pay more attention to the robberies and drug dealers and vandalism then worry about whos staying in whos house when there at work or school.

I am only 20 years old and now my credit is totally ruined for the time bieng. And TCS won't send me toa court, and ive begged them plenty of times to sue me. But instead they just harass me.

I had one of the collection ladies yell and scream at me and say stuff about my mother. They just rather harass me and not take me to court. As far as im concerned they beat me beacause my credit is ruined and I cant afford a lawyer to get my credit back to normal, and they wont dare sue me so theres not much I can do right now. Theres no way I am paying the $1138.00 plus all the other fees they want now.

Its hard for a full time worker and student to deal with this and try to get a career going with computers.And with my credit bieng thrashed I cant build myself up.

I also am Fighting Desert Star Now, They have had a BED BUG problem and at sign of lease was not given LITITURE on Bed Bugs as i think it is state law they have to. Also on lease it says month to month inspections would be done never did. Also says No Dangerios breed dogs but yet they still let them there. As a fact a Pitbull tor small dogs up. Also a Husky owned by Cleaning person attacked a small dog. As for bed Bug problem they before i moved treat Many apartments in many buildings one at a time so basicly chaced bed bugs around the complex. I fought them over replaceing a Fridge for months before it did quit and i lost 100.00+ in food. They used Carts from stors to do things and that is againt the law. They left fridges with doors exposed and same with stoves and that is danger to kids. I had to chace kids out of pool area because fence was broke and they got told so and took PHX city complaint to get that fixed and was broke again when i left. i told them many times to fix TUB and Toilet, They had guy spend a day only thing he did was set the toilet back way it was and leave a biohazard mess for me to clean. neither was fixed. It took them 8 days to replace a A/C unit after many complaints and writen notice. The staff is RUDE even called me and acused me of Calling PHX FIRE on them when i didnt week before i left. Now they want 750.00 and to that take me to court ill stick ya with a counter suit of 10k for 6 months rent items i had to destroy because of bed bug infestation' DIDNT see one till exterminater came in after going into infested apartments", Mental anguish and more. Glad to see this post and hope more follow as i know others i have friended are doing same

Desert Star Apartments RIP OFF, TCS collection agency ..judge waived all penatlies - pay no extra fees, still harassing me (#7381) They filed the following rebuttal to the above Rip-Off Report: Their email: [email protected] Their name: The Internet Consultant Their relationship to the company: Consumer Suggestion Rebuttal: First off I would like to say "GOOD FOR YOU" at beating this Apt Complex at their own game. Then what I would suggest is spend some time at the library and figure out how to SUE THEM. From what you wrote, they didnt return any DEPOSIT, so I would sue them for that. Also file a CONTEMPT MOTION against them in the court that you have a judgement from in your favor. Go on the OFFENSIVE against the APT Company and also name the Collection Agency as a Co-Defendant. This should get their attention and if you WIN again, you should come out ahead. Hopefully at their very least they will LEAVE YOU ALONE !!!!
