My son played flag football for Diversity Youth Sports (DYS) In the spring of 2012.  We registered on-line and shortly after were contacted to meet at a local school for a team meeting.  During that meeting we were told we had to purchase uniforms.  David Noll said that their credit card machine was down and that they had to take our numbers the old fashioned way.  That was March 25th 2012.  The season began and my husband helped coach the team.  In April we were asked to pay for pictures and given a form asking again for credit card numbers, cvv codes, signatures and expiration dates.  I paid check. I never received pictures, nor did any of the parents from our team. Then we were told we would have a team party at Discovery Park that never happened. They said they would donate all money intended for the party to charity on an email.  Season ended, and I didnt think about DYS again.
However, in June they begin to debit my bank account for increments of 25.00.  This occured 3x between June and July.  Then at the end of July they hit my bank account for 95.00 4x within 2-3 days.   I called DYS and there was no answer, no return phone call either. I reported to my bank and the police.  However after you get refunded from the bank the police cannot investigate because the bank becomes a victim of the crime.  I reported my complaint along with several others on their FaceBook page and learned they had done the same thing to dozens of parents in Orange County Ca, as well as Las Vegas.  I reported them to the BBB, the FTC and the Attorney General's office.  I have called their "corporate sponsors" listed on their website. I called KTNV Channel 13 news in Las Vegas because their investigative reporter, Darcy Spears, had already profiled the company in a previous report.  She came to interview myself and a fellow team mother who had also had money stolen from her bank account.  They have aired the story a number of times in the past several weeks. 
It gets better..DYS sent a copy of a letter from a company called Global Payments supposedly addressed to Diversity Youth Sports. The letter stated that it was possible credit card information was obtained illegally by a security breach at their company.  The letter had a reference number on it and an 800 number to call for information, so I  called the phone number on a letter they provided from Global payments Inc. I referenced the number at the top of the page and was told by 2 different operators that the letter in question was NOT addressed to DYS, but rather an individual that applied to have a credit card machine at their business. Further they told me that the only information that was compromised was the specific information on the application for that individual. "It had nothing to do with their customer or client base." So as usual it is another attempt for dys to defraud the public.
Now DYS issued an email to me trying to bully me with a lawsuit if I do not retract my statements on the news. Nothing i said was false and i stand by my statements.   I have contacted the news and intend to continue my reslove to ensure this happens to no other family. If you have been a victim please contact the BBB and Channel 13 News.  Contact the FTC as well as your local police department.  Something has to be done to stop these crooks.

This is what Mr. David Lee rebutted above. I was one of the Anaheim (Orange County, CA) victims. Well Mr. Lee, we did contact our coach Sergio and had a team meeting with him after your company decided to vanish into thin air. No team photos, no trophies, no sign of any DYS employee whatsoever. I think you are forgetting that you gave Sergio (our coach) a paycheck that he couldn't cash. His bank said the check was fraudulent. Don't worry though, Mr. Lee. We all filed a group police report with the Anaheim Police Department. 

Oh, and this so called "press release" you posted about a lawsuit against investigative reporter Darcy Spears.... paying a third party service to publish a press release that you or your company wrote is NOT a news story. News journalists have correct grammar and proper punctuation and proofreaders. You might want to fix this fake press release...

There was a lot of disorganization with your company obviously, and I even suggested great ideas to the older lady who ran it so that this company could actually run an honest and legitimate business while the kids had a blast. The idea and concept was good, the taking money from people's bank accounts was not. The look on my son's face when we went to our Saturday game and nobody was there? Heartbreak. And for this, I have no pity for seeing you scamsters rot in jail.

I did find it kind of fishy when the older lady rolled up to the team photo shoot in a brand new Audi sports car, pulled out a point and shoot camera, snapped two photos of our team and left. Very professional team photography. No crime in that, just ridiculousness. Hey older lady, next team you get team hats for 3 and 4 year olds, make sure you don't get the adult sizes. Word to the wise.

Hey David Lee, cease and desist to the original post Heather? Stop with your pitiful online threats. You can't even threaten correctly, let alone run a company. How much of our stolen money did you pay a lawyer to construct a letter like that? Nothing, because there is no lawyer that you can afford to get you out of this mess. Johnnie Cochran died years ago, unfortunately. 

Its funny how I saw the news report when Darcy Spears went to your home with a metal screen door on it. Is that for protection from all the parents? That's the smartest thing you've ever done, because you don't realize how many angry parents we have here in Orange County. We're talking like football player-sized parents who saw nothing but red when your name came up. Be smart, don't come back to the OC.

Oh and your regional director David Noll? Um.... yeah. He tells the plain old truth about your company.....

Hey, don't forget to contact the Better Business Bureau. They want to let you know that you are NOT accredited by them as you stated on your website. Good job for taking that off your website before you were caught in that lie as well. Oh wait.. what's this screenshot I have? Ah yes, I must have accidentally took a screen shot of your website BEFORE you took off the "BBB Accredited" sign. 

Feel free to rebutt my rebuttal, Mr David Lee, you don't have much time. Federal prison isn't as bad State Prison, from what I've heard in movies. Let us all know how it was in 5-10 years after you get out, OK? Thanks.

 Many of your statements about Diversity Youth Sports, LLC in the media store by Darcy Spears of KTNV Channel 13 Las Vegas  are untrue and defamatory. These statements were made maliciously to injure Diversity Youth Sports, LLC in its trade, office and profession. As such, they are defamatory per se. Under NRS 41.331, this letter constitutes a demand for immediate retraction in writing of these false and libelous statements. In accordance with NRS 41.338, Diversity Youth Sports, LLC demands that your retraction and correction be accompanied by an explanation in which you specifically repudiated your libelous statements.

The statements you made were turned into web postings and video conduct that also constitute tortious interference with the business and contractual relations of Diversity Youth Sports, LLC. As such, they are actionable and expose you to the imposition of compensatory as well as punitive damages.

Below, we have noted some of the more patent, malicious, and libelous comments made by you in your media posts; some of them also evidence your tortious interference they are all false. If Diversity Youth Sports, LLC is forced to file suit to stop your wrongful conduct, it will also seek an award of its attorney fees, litigation expenses and damages from lost business.  The following statements are false:           

"One of the reasons we went with them was because they're cheaper than some of the other facilities out there," Heather explains.  "And the parents that are signing up for these things aren't in a position to be able to have $400 or $500 missing from their account and have to dispute it and not need that for their families.  So it really is a crime that they're victimizing families."o   This in not freedom of speech to accuse a person or organization of committing a crime. It is Slander per se, under the Nevada Revised Code and is punishable by harsh civil penalties.          

"Within the last week, I believe they've hit my credit card between 4-5 times for $95 a pop," adds up. And both women say new charges were attempted by DYS even after they canceled their cards.o   While the charge may have APPEARED to be from DYS, it was not. It was part of a larger scam that hacked into the secure data servers of our credit processors and retrieved over 1.5 million card numbers. Your assumption that DYS mad this charge and had gained from this charge is malicious, and libelous.          

On top of the unauthorized charges, Heather says they paid for team pictures they never got and an end of season party that never happened.o   As is done every season, team photos are given to coaches to hand to to teams. If you were concerned you could have come to the office and picked them youre yourself. Contact your coach; they should have the photos, If you paid for them. A copy of the notice regarding the use of your card in enclosed.Your failure to correct your erroneous and false statements and their repetition after notice of their falsehood constitutes further publication of libel. It also confirms your malicious intent.

If you do not immediately publish the requested retraction, and cease and desist from tortious interference and making false and malicious comments about Diversity Youth Sports, LLC, it's officers, and its programs, we will file suit against you. Please govern yourself accordingly.  You may send you retraction to [email protected] on or before Monday, August 13, 2012 to prevent further legal action.
