Here is my story.




My car was towed from a Providence Park (Townhomes in Dunn Loring) Visitor Parking Spot at 0525 (3/13/10) (as indicated on the form provided by Dominion Towing, "Dominion").  The visitor parking spot is clearly marked with a sign that indicates that the spot is available to visitors for 6 hours only.  Dominion's phone number is also on that sign.





Here is the issue.  My car was towed in less than 6 hours from when I parked in the spot.  I parked the car at 2348 (3/12/10) in said spot.  The Driver who towed my car (Driver #6, according to Dominion) indicated that my car was spotted at said spot at 2045 (3/12/10).  This is a complete lie because my car was parked in a Clarendon parking garage from about 2010 (3/12/10) to 2321 (3/12/10).  I left my small group bible study in Clarendon at about 2315 (3/12/10) and arrived at Providence Park at 2348 (3/12/10).





Since I parked at 2348 (3/12/10), Dominion legally had no right to tow my car until at least 0548 (3/13/10), assuming they had spotted my car as soon as I got there.  Also, Dominion lied about spotting my car at 2045, since my car was parked in another lot at that time.





I was able to narrow down the times so precisely because:


I called a fellow small group member at 2320 (3/12/10) to meet him outside the garage to give him a CD. (Can verify with 6 calls back and forth on my call log from 2320 to 2323, now reading 0020 to 0023 since phone automatically adjusted for Daylight Savings Time.  I had poor reception, which is why it took so many calls.)


I called my girlfriend at 2348 and 2349 upon arriving at Providence Park to let her know I had arrived. (She was in the bathroom during the call at 2348, which is why she missed my first call.)





I was able to get to Dominion to retrieve my car around 0730.  I tried to reasonably ask that they release my vehicle since they had towed it illegally, but they would not release my vehicle unless I paid $125.





I am going to try to speak to the manager on Monday to see if he will be reasonable.  If not, I may have to sue at small claims court.

On April 30, 2010, my case tried in court.


We attempted mediation with two mediators appointed by the state, but an agreement was not reached.

I presented my case to the judge, and the defendant presented his.

Because the actual driver did not appear, the judge considered the defendant's evidence as hearsay and rendered judgment to the plaintiff in the full amount plus court fees.
