After many many payments later drive kept harassing me 7 months later claiming I missed some payments I know that I have never missed a payment so after many months of this the whole time I was still making my payments I was called @ least 2 to 5 times a day about the matter they claimed I missed 4 mont5hs of payments and wanted me to catch them up and were charging me late fees and calling everyday telling me I needed to catch them up I ask for payments I made they wouldnt send it to me.

One person I spoke to claimed to be supervisor said I was all up to date, then the next day I got a call saying I was 2 months behind. I finally just told them if the wanted the vehicle come and get it. I already paid 40 payments of a 52 month loan before they started harassing me evryday. I just decidede I was not going tro win with these peaople and decided to just let the vehicle sit @ my home until they finally come and got it. I stopped paying on it period.

Now they are suing me and trying to get a judgment against me for $2700 I just need somone to help me out here becasue I know I never missed pAyments I have a very good job and financially stable I would really like to get in on a lawsuit against these people contact me PLEASE!!!!

I completely understand your grief with this company. Last night, they sent a repo man to my house for missed payments. Do you know that HE BROKE INTO MY GARAGE. He tried to pull my car out but instead jammed the car into the wall, damaged some of the foundation in the garage, scratched up the car, and damaged the garage door and the side of the house. He abandoned the car halfway out of the garage and drove off. But, he did not get very far because his tail was caught and he was arrested last night for breaking and entering. We will file charges and sue. Aside from the fact that he was hired by Drive, what is worse about this situation is that I have three small children. What would have happened if they were up and entered the garage when he was trying to take our car? When I mentioned this to Drive today. I was told by this awful woman that that it was my fault and if anything happened to my child, it would have been our fault. Then she tried to say that we were harboring our car. How is that possible when the car is parked in our garage at the address that we live. And if the missed payments were so much and it was thought that I was hiding my vehicle, where was the sherrif? Why did I not receive a court order? Is that not what a garage is for? I wish I could go after Drive as well by right now our issue is with the repo man who I hope had a great night in jail last night. Whoever gets a suit against them, I wish you well and much success!!!

I just received financing from Drive in March 2008 and already they are harassing me, calling 3 times a day requesting payments before they are even due. I asked to have my due date changed from the 7th to the 28th. They refused. I told them I am on SSD and receive it on the 4th Wednesday of the month, which they were made aware of before they offered and I accepted the loan. They don't care. On top of that, they want you to pay a processing fee of 10.95 to pay your bill by phone or on their own website. So on top of my 539.00 monthly payment, I am paying this processing fee so that my payment is not late. This is asinine. Judging from all the complaints I have read here I already know that I have an unpleasant time ahead of me. Hopefully someone will actually investigate this company and its practices. Where are our state and federal lawmakers? They should be reading this site regularly. I have found three of my creditors on this site with numerous complaints. One with over a thousand. Try Schneider, Wallace, Cottrell, Brayton and Konecky. LLP. They are out of California but maybe they have a referral.

IF you have not missed any payments and/or have not been LATE with payments, your personal financial records should be proof enough. Statements from your bank account, credit card, money orders and such should show the dates that they received payments. At this stage of your situation, joining someone else's pending lawsuit isn't going to help you. This is the root of your problem-you simply stopped paying without any resolutions of the issues you claim. If you made some late payments, there are late fees that the assess to your account. If you don't pay the late fees, more non-payment fees are added, tossing your account further into arrears. Also, after the initial confusion, it would have been better if you had written them with a certified, return receipt requested letter to resolve this. Unfortunately, telephone discussions don't always work as you've seen. I would suggest you attempt to resolve this before you have a judgment against you. You should carefully review your financial records to check the exact dates that payments were posted to them/charged to your bank account/credit card. Good luck.
