I bought a 99 nissan pathfinder in april of 2003. On August 28th, 2003, I was involved in an accident, resulting in a $1700.00 a month paycut. I got behind on my payments by one payment, not only because of the paycut, but I honestly thought they were going to total the vehicle. I have been harrassed relentlessly by the drivetime finance department. They call me 128 times in 45 days, and technically, I was only 10 days past due. I would make arrangements to pay them, and they knew I didn't get off of work until 5pm, and they would call me at 5:15 to ask me where I was with the payment. Finally, I stopped answering all calls, allowing it to go to voice mail, continuing to make my payments, and attempting to pay a little extra to make up the missed payment.

One of the finance people called my house. My daughter answered the phone. She told them I was at work which I was. They told her, "Tell you mom we are coming to reposses her truck if she doesn't call us today. My daughter panicked. She's only 12. Then, Carlos Garcia from the finance department called the main line to my work and talked with the CEO of the company about my delinquency! He was being so rude to him that my boss finally hung up on him. Since this phone call, the company and my bosses have been treating me like crap, and now I've heard rumor that I'm getting fired on Monday. Is there something I can do about this?

A local law firm has had me come in on many cases that involve car dealers and their funny ways of doing business. If you go to court make sure your lawyer has a good expert whiteness. Car dealers and their attorneys hate it when a plaintiff has an expert whiteness get in front of a jury. I helped a local lady here in Phoenix win her case against a local Dodge dealer. She got her loan paid off and some good money in her pocket. The thing to do is have your story in a clear order and have copies of everything so you can give copies to each juror. Trust me photo's help in a a big way. Your goal should be to get your case in front of a jury !

I work for Toyota Financial Services, I am a collector. By law if you asked Drivetime to not call you at your place of buisness, and they did you can sue. If they say the word "repo" to antone other than you, thats called third party disclosure. You can sue. They spoke to your boss at work... he's not on the auto loan... third party you can and should sue. For the cost of your car, for the harassment and then a little extra for putting up with the phone calls.
