     On August 14, 2011 we entered into a binding contract with Eagle Van Lines LLC to move household goods from our residence in Missouri to Derry, New Hampshire.

     On September 21, 2011 when their van arrived for pick-up, some red flags went up.  First, they would not accept a credit card for the second payment although a credit card was accepted for the initial payment.  We found that they did not have an adequate supply of moving blankets for our furniture and they did not have any copies of the brochure, "Dispute Resolution and Arbitration" promised in the contract.

     The next day, we learned that the Company had either gone out of buisness or had filed for bankruptcy.  They assured us that our shipment was in their Houston warehouse but subsequently they informed us that the volume of our goods was greater that that specified by contract and that an additional overage fee was demanded, a claim we disputed.

     We then learned that our shipment was not in Texas but somewhere in Arkansas, perhaps in Rogers, AR.  Ultimately we learned that it was in Bentonville, Ar in a commercial storage facility.  When we contacted that facility we heard for the first time that in addition to our items in the storage unit, there were possessions belonging to a party in Minnesota who was working with the MN Attoryney General to obtain lelease of their goods.  A call to the MN Attorney General's office lead to a contact with That party; it was the first time that we learned that there were others affected by Eagle Van LInes.

     Working with that second party, release of the stored items was secured.  W met in Bentonville and gained entry to the unit and found that indeed our items as well as theirs was in storage.  Upon exptaction of the items, which were crudly placed inside. wwe found that several of our items were missing and that all items had received some degree of damage.  We joined with the second party in renting a truck so the the contents of the storage unit could be removed to Missouri and then on to Minnesota.

     In addition to the above issues and related expences, at one juncture, we were told that a truck was being dispatched to MN, then on to New York and finally to NH.  Based on that information, we traveled by car to NH only to return disappointed and our expectations shattered.

     We contracted with Eagle because they had promised us a sizable senior citizen discount.  That turned out apparently to be the old bait and switch scheme.  In addition to being lied to, the tenants of the contract breached, our goods missing or damaged, there were additional incurred expenses to both AR and NH.  In this case, we feel there is nothing to arbitrate, that the full sum paid to Eagle needs to be returned and additional fees for damages and out of pocket expenses  levied against the Company.  For a full report of these expenditures, contact us at the above contact information.
