This is hilarious, you think you were "being nice" by continuing to pay them $249 a month. Sorry, but if you wanted to keep the car you are REQUIRED to continue to pay on the loan. If you did not reaffirm the loan there is no additional damage that can be done to your credit. That is if you are 30,60...days late it can not be reported on your credit. But you are in default so they can still reposess the car. If the car is reposessed it can not be reported. The only thing that it will list is what it lists now "Included in Bankruptcy". There is no requirement that says a bank MUST work with you, in fact you will find that if you are in this situation most won't. If you did reaffirm the car loan then you lost all Bankruptcy protections and they can not only report you late, it can be listed as a Reposession and you will still owe the balance of the loan after they sell it at auction. The only ripoff, if it did happen, was them claiming they could go after you criminally. The only way this could happen is if you hid the car forcing them to get a court order for you to turn it over.
