This story is very simple. I purchaed a product via Ebay and Paypal with guarantees from both companies that my purcase would be protected by both companies and the purhase was not. I am a frequent purchaser on ebay with an excellent history and track record on the site. Ive been scammed in the past by ebay sellers but the items were not expensive so I never complained because the process that ebay and Paypal make you go through to file a claim acts as a deterent in my opinion, so I never filed claims because I felt my time was worth more than the pain and energy these companies put you through to file a claim. However, this time I purchased a very expensive Rolex watch that arrived damaged and because the watch was packaged properly in my opinion the damage happened prior to the sale and was not disclosed by the seller in my opinion as well as my Jewlers opinion. I tried to file a claim with both Ebay and Paypal, but Paypal told me to go to Ebay and in the end ebay made a decision siding with the seller stating that I did not provide them with enough information. They made the process so difficult for me, I never even felt like they had any intensions in helping me and it felt like they were protecting the seller the whole time and in the end they sided with the seller and I am left with a very expensive damaged Rolex that I purchased from a unethical Ebay seller who in the end was backed by both Ebay and Paypal. I am expecting Ebay and Paypal will remove me from there sites for speaking the truth but they have left me no choice. Buyer Beware, you cant win when going up against Ebay or Paypal and there guarantees are fraudulent advertisments in my opinion from my experience.

Its unfortunate but both ebay and paypal both use investigators. You tend to see these types of post because one side or the other did not get thier way. What it really boils down to is which of you they believed. Obviously they believed the seller in this instance. Where its unfortunate is that most ppl are under the mistaken impression that the company used to do the shipping is going to take perfect care of your product. This is as far from the truth as it can get. Even "properly" packaged a product can be destroyed by the way its handled. I have personally seen giant foot prints on top of boxes labeled FRAGILE. So if you did not take shipping insurance and you dispute the condition of your purchase, nine times out of ten its going to be the shipping company that has destroyed your item. I would take the fight to them.
If you really want to show whichever shipping company how bad they handle packages, have a family member a few states away ship you a raw egg. "Properly" package it. Then when it arrives open it in front of the driver. Im 100% sure that egg will be destroyed.
In the end, all ebay and paypal can go on is who is more believable. Obviously they didnt buy your story. The odds are good that your product was damaged by the package carrier. Aim your cannons there next. As both ebay and paypal WILL demand that you prove the watch was damaged upon your recieving it. If you can not prove that then you should be able to understand the WHY your claim was denied. They just cant take your word that it was damaged. The American consumer has lied and cheated thier way into getting something for nothing. You can not blame them for covering thier corporate asses. No business would be able to stay in business if they did that. So yes, they believed the seller over you. It doesnt change the fact that both ebay and paypal do what they can. In this case the seller was either more believable or had better evidence then you did. It doesnt violate the system. It just says that they were better armed to defend against accusations.
