I signed on with this company a little over a year ago because a friend referred someone she had used that set her up with no monthly minimums, or termination fees which was what I was looking for since the last company I had used "Bancard" also out of CO I believe, had also changed the terms of my agreement and increased rates. So I spoke to Pete Tatro and he set me up with EXS with an interchange plus retail swipe rate, and none of the aforementioned fees. However on today's bill I notice I have a monthly minimum charge on there- which I had seen on another months billing cycle but for some reason I thought it was a compliance fee and didn't question it. I called customer service and spoke to a woman named Michelle or "shelley" who tells me my agreement was "applicable to change at any time" so I ask her where it states that and she says under amendment 17 -which I look at and it states I need to be notified in writing of any changes- she then says I was notified on my billing statement, I pull out an old statement and it says:

"Please be advised that the associations have announced certain rate increases to be effective April 2009. Effective as of the same date merchants may see increases to certain rate categories. In addition, as a result of new fees assessed and announced by the card associations and increased expenses to your service provider there will be a separate line item for new fees on your merchant statement including a per transaction access fee of .0075 for discover and .0195 for Visa and .0185 for MC transactions".

She then proceeds to tell me that if the new fees are non negotiable and if I want to terminate my contract they will "waive" the termination fee. WHAT? supposedly I did not have a termination fee? They are willing to let me out of my contract that they changed without my approval though. The customer service rep drops the f-bomb on me when I start getting frustrated, so I ask to speak to a manager who I can tell sounds tired of dealing with this issue from customers and has no desire to resolve this at all. She tells me that this charge appeared on my April bill and as a business owner I should have noticed it and called them - so it is my fault. I tell her I should not have to nurse a SIGNED AGREEMENT every month and the "deceptive blanket statement" on my bill says nothing about the addition of monthly minimums or what fees are being added to MY CONTRACT or that I was going to be one of the selected merchants affected. She spoke to me as if I was an uninformed idiot who didn't read her contract agreement when I had completely scrutinized it do to my last bad experience with Bancard. These people incense you with fees and notices that you just get numb and then when you do fight they tell you it is not negotiable so just leave- and the final kiss off is the verbal abuse you receive over the phone from their "customer service" dept and management!
