Your issue is not with the insurance company. It is the other driver that owes you. That driver has a contract with his/her insurance company that covers his/her liability. That contract says that the client must cooperate fully with the insurance company in the handling of a claim. If the client does not cooperate, then the client is on the hook for his/her own liability.
This is how all insurance works. But the bottom line is that you have no contract with the insurance company. Your beef is with the other driver, who is legally responsible for the damages. If you want to file suit to recover damages, it would be against the other driver (whom you claim is liable), not the insurance company.
