Everest Asset Management - FDCPA VIOLATIONS, ABUSIVE BEHAVIOR AND HARASSMENT! Miami Florida
My Wife received a call from Everest Asset Mgt concerning a four year old debt she had prior to our marriage. My wife returned the call and explained to the girl that she would like to resolve the matter but could not pay it in full all at once. Before they could work out the details of a payment plan her cell phone dropped the call.
She then received a call from "Jack" (I think his last name is Lucas) who immediately was rude and abusive. He told her she was refusing to pay and if she did not pay immediately that she would be sued and her wages garnished. She explained that she was 8 months pregnant and on disability but would like to set up a payment plan. Jack then asked her if she was married. He threatened that her husband would also be included in the lawsuit and his wages garnished.
She tried to explain that she was not refusing to pay, that she was in fact trying to set up a payment arrangement. Jack cut her off, told her he was marking her account as "refusal to pay" and would be suing then hung up on her.
My wife called me at work very upset to explain what happened. When I called Everest Asset Mgt to speak to Jacks supervisor they refused. Jack got on the phone and proceeded to tell me how he never said those things and that "you know how women are," and "she was crazy."
Obviously this company uses these tactics on a regular basis and should be looked into. Everest Asset Mgt is highly unprofessional at best and possibly criminal.
