I am so glad I found this website. I have read EVERY report on Fairbanks Capital and I can only think of the thousands of other Fairbanks victims out there that have not found this site.

I am also a victim of Fairbanks,We are facing foreclosure even though we have made every single payment to date!!! Fairbanks had added lender placed insurance on our home, even though I had provided proof of insurance on 11 seperate occations!!!

I even have a letter FROM FAIRBANKS stating that they had recieved my proof of insurance and that they cancelled the force placed insurance (letter dated 9/03/02). But they took my November and December payments and put them in some kind of slush fund and called them "partial payments". Being that these payments where not applied towards my loan I am now facing forclosure. I later learned that my December payment went to legal fees, "drive-by appraisals", and letters, yes letters, they charged me for the letters that they had sent me.

I kept thinking that this will eventually work out being that I had proof of insurance and had made all of my payments, eventually I would talk with someone at Fairbanks that was competant enough to fix their mistake. Then I found this site. I now realize that there is no such thing as a competant person at Fairbanks, and I realize that I am in real trouble.

This website is great and had opened our eyes and let us know that we are NOT ALONE. BUT we need to do more, the idea of ALL OF US WRITING TO 20/20 AND DATELINE ON THE SAME DAY IS PERFECT!!

I want to execute that idea and set a date for all of us to do so. Next Sunday, on FEBRUARY 9th 2003 we NEED to write to DATELINE and 20/20. The impact of dozens (hopefully hundreds) of emails on the same day should get someones attention. I also recommend that we use the same "subject" in our emails, simply

(RE: FAIRBANKS CAPITAL CORP)

TAKE THE TIME AND DO THIS FOR YOURSELF AND ALL OF US HARD WORKING AMERICANS THAT HAVE BEEN RIPPED OFF AND RUINED!!

DATELINE- [email protected]

20/20 - go to www.ABCNEWS.COM ; click on 20/20 ; then under RESOURCES click on EMAIL 20/20

ALSO...VERY IMPORTANT...FILE A REPORT WITH THE FEDERAL TRADE COMMISSION!!!! I filed my complaint over the phone 4 days ago,it took 20 minutes...DO IT NOW!!!! 1-877-382-4357 This is VERY VERY IMPORTANT!!!! The FCC WILL take action if they have enough complaints!!!

also, call your Attorney Generals Office!!! Today!!!

I am currently building my case and have spoken with several law firms that would consider class action suit...again I (WE) NEED YOU!!!!!! If you live in Florida or even the Southeast...and you have PROOF that FAIRBANKS CAPITAL has ripped you off or has acted unlawfully towards you.. I will not go without a fight, FAIRBANKS CAPITAL WILL BE STOPPED!

DON'T FORGET EMAIL DATELINE AND 20/20 NEXT SUNDAY FEB.9th let everyone else know that has had problems with FAIRBANKS, if they don't have the time to write the email then you do it for them!!!

UNITED WE STAND!!!! Also file a Rip-off Report here!

My loan was with equacredit morgage company and this company was bought out by Fairbanks. I have had nothing but truoble with them since. They are consistantly putting late charges on my account saying they did not recieve my payment on time . I started sending it with a tracer number on it so I know when they recieve it,this seems to have stopped this problem. I had a problem with the insurence they imposed on my account also. I had insurence and had the policy sent by fax to them three times ,but they say they did not recieve it. I hate to call them to try to correct problems because it takes for ever and many calls to get thing straightened out. I have two loans with them and I sent my payments in and they reversed the payments. Paying one ahead for several months and the other loan was then not covered for one month it took three months and untold amounts of calls to correct this. It was reported to the credit bureau that I was behind on my payments and I was billed many late charges. What a mess!! and I thought I was the only one. I was so glad to find this web site!

Is Florida the Predatory Lending capital of the universe?

God! I just read your hair-raising story on your mortgage, and I wish you all the luck in the world. I recently had a horrible experience with another predatory lender in FLorida, World Savings Bank. I have complaints in process with the Florida Commission on Human Rights, the Office of Thrift Supervision and HUD. I never consumated the crappy loan, so our circumstances might be different. The Office of Thrift Supervision has been the best for my case so far. Depending on who regulates your crappy mortgage lender, you might want to contact them also. The more the merrier! The regulators have the power to yank their regulatory charters, impose fines, and limit their growth in a given market. If enough consumers complain about the same sorts of things, the fines go up in geometric proportions. If criminal activity is found, the Department of Justice will get involved and litigate, no cost to the consumer. I really wonder if Florida has some gaping holes in their lending regulations. Or, banks down here must think consumers have the IQ's of bricks or something--there seem to be a lot of horror stories coming out of this state. Good luck to you on your case, and thanks for posting!

FAIRBANKS CAPITAL IS A PREDATORY LENDER

#5Consumer Suggestion

Your suggestion to email 20/20 and Dateline on the same date is a good idea. Fairbanks is a predatory lender. This should be noted in the email, so everybodys' story is alike. It will get more attention. The FTC and State Attorney Generals are well aware of predatory lenders and Fairbanks is on top of the list. Predatory lending is common practice and the FTC has a list of what it describes as predatory lending practices. Some news attention has been given to predatory lending, so PREDATORY LENDING should be included in the email caption to give the mail a common cause. Good Luck and God Bless America

I have already e-mailed: Dateline, 20/20, Primetime, The Attorney General (Ohio), local news stations (Ohio), Oprah and wrote a letter to the Editor of Good Housekeeping Magazine. I think that is a great idea for everyone to do it on the same day, and I will AGAIN e-mail them on Sunday. I am still in disbelieve that Fairbanks can keep getting away with all this bull----. I hope all of us TOGETHER can make a difference. I also am in contact with a lawyer in S.C. and trying to find a lawyer in Ohio to take on Fairbanks. They must be STOPPED! Keep me posted :-)
