I filed a complaint with the Indiana Attorney General and have already received a response. The address is : Roy P. After repeated phone calls, a gentleman named Cordell Miller actually did track down our payments & got them credited. He is our account representative. I feel credit should be given for his helpfulness although it still was not timely. The payments were misapplied (on time) to another account.
Of couse they were not applied to my account on the date the cashiers check cleared..only when they found them. It looks like a late payment on their activity paperwork. Cordell told me that each rep has a fax machine on their desk. So, continue to call them daily, don't lose your temper. Have your proof ready.
I'm so amazed at the foreclosues this company can proceed with in spite of the proof of payments. The attorney for Fairbanks told us there are no court appearances during foreclosure. It is all done on paper. If this happens to me again, it will not be on paper. I will force them to court to prove their allegations. My report to the Indiana Attorney General was sent yesterday. I will be contacting the media this week. Good luck to everyone who is involved in this mess.
