Don't let the prepayment penalty deter you from refinancing. It's actually a tax deduction (see IRS Publication 936)or call 1-877-777-4778:

Mortgage prepayment penalty. If you pay off your home mortgage early, you may have to pay a penalty. You can deduct that penalty as home mortgage interest provided the penalty is not for a specific service performed or cost incurred in connection with your mortgage loan.

Do not go thru Fairbanks customer service. Send all complaints and inquiries in the form of a HUD Qualified Written Request (http://www.hud.gov/offices/hsg/sfh/res/reslettr.cfm - example below)to the attention of either Terrell W. Smith Esq. (their registered agent) or Kimberly Moon (their litigation specialist) at 3815 SW Temple, Salt Lake City, UT 84165, or fax to Kimberly Moon at 801 293-2555, or email Kim at [email protected]. If they fail to respond within 20 days and do not resolve your issue within 60, they can be sued in Federal Court.

Describe any conversations with customer service regarding the issue and to whom you spoke.

Describe any previous steps you have taken or attempts to resolve the issue.

List a day time telephone number in case a customer service representative wishes to contact you.

I understand that under Section 6 of RESPA you are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days.

REMEMBER: This letter SHOULD NOT be included with your mortgage payment, but should be sent separately to the customer service address.

You SHOULD continue to make the required mortgage and escrow payment until the request is resolved.

You may bring a private right of action under Section 6, if you suffer damages due to the lender's servicing of the loan. See the RESPA statute and regulations.
