Fairbanks Capital acquired my loan from First Union with a zero balance.

The first letter I received from them was a demand letter that I had 30 days to pay $74,000+ or they would start foreclosure proceedings. My original loan was $14,000.

I made numerous calls to them. They stated over and over that the letter did not come from them. Until I faxed it to them. I was then notified by someone that I should wait until I receive a payment book or statement to make a payment.

After 5 months and nothing. I phoned in a $600. payment. At that time, I checked my balance, it was zero!

A few more months went by and I made another payment. Still nothing in the mail. A couple months later, a foreclosure letter from an attorney.

The plaintiff was "JP Morgan Chase", whom I've never heard of. I was forced to pay three months payments and 1500.+ of attorney fees for the one letter that they sent.

I am a legal secretary and know that one letter does not constitute a $1,500.00 charge. I asked the attorney's office for a breakdown of the charge. They told me to ask the mortgage company. I asked Fairbanks Capital and they told me, "that's what they charge."

I received a "Order of Voluntary Withdrawal" once I paid. However, the court has still not received it. This was sent on 01/16/03. The attorney's office claims to have sent it twice. The Palm Beach County Clerk says they have not received it.

Today, I get another letter from the attorney, starting foreclosure proceedings again. I will fight this one!
