WOW, WOW ... what do you think of this one... It's Sunday morning and I just got off the phone with Mr. Shuster's (CEO) of Fairbanks Capital's right hand man just called me... I asked him where is my money... and what is a suspended account?

I also asked him if he was making payments to pay off a loan and they told him that his payments were not being applied what would he do... And of course he said I would want to know where my money was too.... Well then Show me the money... I go to court tomorrow for a forclosuer proceeding... Funny when you have had enough and start searching what comes out in the wash.....Oh I also have been waiting for a payoff statement for 4 months, haven't had any money applied to my loan in more then 3and a half years.... They say I owe 3,000 dollars more then my original loan was taken out for 4 and a half years agao... is that even possible???? I think not.

Good luck to all in the hunt for our money and dignity. They hold a seond mortgage on my house not even the first...

Well They sent a forbarance agreement..LOL to keep from crying ..It was already dated 2 days ago so if we sign it we would already be in default. I really wonder who it is they think they are dealing with...let's see they take our loans because for some reason we have a bit of trouble in our lives. Sorry I can't afford jet fuel or even a seat to put in a jet. Why can their CEO's fly them home? I have written letters to our states attorney Govenor and Hud and Any other government site I can. I think everyone who has written in on this forum should do the same... More can get done with the masses.....Gotta go good luck to all try and get a goodnights sleep...LOL

You are not alone

Robin, I just wanted to let you know you are not alone. There are thousands of people just like us that this company is stealing from very day. Our story is almost identical to yours and we to have been victimized for the last 3 and a half years and they have not credited one cent to our account. we went through a foreberance agreement but that didnt work either. We also went through 2 repayment plans but they being Fairbanks held our payments until they were late. We had to file chapter 13 in Dec. 2000 and since then they have tried to have the stay lifted so they could forclose on our home as a matter of fact they have tried twice. No one seems to know were the money is going and the suspence fund is a joke. We two asked for a payoff last Dec, and Fairbanks charged us $60.00 to tell us we owed them $9,000.00 more than what our loan was for back in 1998. We have paid them over $37,000.00 since they bought our mortgage in 2000 but not one cent has went towards principle. THIS IS CRIMINAL. Our attornet has been working on this since last Nov. and she's getting the run around too.

Well The answer I got from him was A suspended account is were money goes that we don't know where it belongs... and I said what about the account number I put on every money order I sent with the requested signature from the postal system... he went silent.... of course .. I recieved a call from another person yesterday saying they wanted to send us our forbearance agreement finally...but when it came today it was already outdated as of 2 days ago... do they really think we are that stupid to sign something that we should have already made a payment on... they also forclouse on faster if you fall out of a forbarance agreement.I contacted A top Lawyer toay dropping off all the information tomarrow morning in Chicago. I will spend the rest of my days making sure these people can't sleep at night like I haven't been able to. I also called Channel 2 News in Chicago and they said they have gotten thousands of calls abouot the story they ran the past Sunday night on Fairbanks Capital.

So did he answer your question re the suspense account? I so, please share it - it may help a lot of people if we had Fairbanks' definition of this term.
