It was recently brought to my attention that these fake accusations have been made against our company. I do not appreciate lies and deceitful information about our company when we have done nothing wrong. Below, I have attached my response to a BBB complaint that we received in association with our dealings with Contractors Choice. The owner of Contractors Choice, George and his relative Mona are running a scam business and have ripped off numerous people - AND I HAVE PROOF OF IT!! MORE PROOF IS THAT THERE ARE 13 DIFFERENT REPORTS ON THIS WEBSITE ALONE OF CUSTOMERS THAT THEY HAVE RIPPED OFF AND STILL ARE RIPPING OFF. Please see the BBB response below - in which I offered to refund all of the money that we collected for Contractor's Choice - WITH ONE CONDITION - CONTRACTORS CHOICE REFUNDS ALL OF THE MONEY AS WELL BECAUSE THEY SCAMMED IT OUT OF THEIR CUSTOMERS. THEY EVEN USED US TO COLLECT THE "SCAMMED" MONEY. READ BELOW, IT WILL CLEAR THIS MATTER UP. AND FOR THE RECORD, THEY DID NOT RESPOND TO MY COMPLAINT BELOW BECAUSE THEY WERE TOO BUSY SCAMMING OTHER CUSTOMERS. May 1, 2006 Better Business Bureau 5050 Murphy Canyon Road, #110 San Diego, CA 92123-4389 RE: #23006972 Mona Kalta Gaby, I am in receipt of your letter dated April 18, 2005. I have reviewed our records regarding Mona's complaint. After completely investigating the situation we have concluded that Contractors Choice Lighting is not operating their business in an ethical matter. First of all, we received a total of 29 accounts from CCL for the purpose of collecting on because they were supposedly delinquent or failed to pay for a product/service provided by CCL. Once our collection letters had gone out, within days, we received 8 complaints regarding the practices of Contractors Choice Lighting and many of the complaints received by our office were stating the same situation. The complaints stated that the products that they received were either defective or not the item that they had originally ordered and that CCL was refusing to exchange or credit the amount, therefore they had charged back their credit card charges. Also, it seems that there is an obvious problem regarding the shipping/receiving department at CCL. Many of the complaint letters stated that they had in fact returned the products to CCL, while CCL claims that they never received the returns, just like they claimed that they did not receive our initial remittance checks to them, (which were in fact sent twice by myself). In the 28 years of experience in the collection industry, with over 800 clients around the nation, we have never experienced this type of response from the debtors of any client until we began to work with CCL. I cannot imagine how many more unsatisfied customers there are that were not sent over to our company for collections. What CCL has done by turning over illegitimate debts to our office, has in fact put them in violation of the FDCPA and the FCRA by attempting to collect on invalid debts. We here at Fidelity refuse to work with a company of this nature and I have in fact turned every document pertaining to the CCL account to our legal department and they are currently reviewing the file for legalities. I personally had a conversation with George who is supposedly the owner of CCL and he in fact began to make threats to me and from that point on, we have refused to work on any accounts and in good faith, I sent him a check (minus our collection fees) for any monies collected by our office. Therefore, CCL has been remitted in full by Fidelity Credit Management for any accounts that have been paid to our office. For the record, we feel that any and all monies that have been collected by our office for CCL were paid by their customer only in order to avoid a negative mark on their credit report. Having said that, because CCL has continued badger and defame our company in their desperate attempt to cover up the fact that they are operating fraudulently, I am prepared to refund all of the money collected to this point, only once CCL refunds the same funds (their portion) collected from our company. Since we began work with CCL, the total dollar amount collected to date is $2,090.28, this includes all payments made to Fidelity Credit and payments made directly to CCL after our collection efforts. Of this $2,090.28, CCL has received proceeds of $1,291.21. If CCL refuses to refund the monies that they have received, I will be contacting our legal counsel in order to make sure that they are dealt with accordingly. I must add that I am absolutely appalled by the actions of Mona and George, whom I believe are related and running a complete scam with their online sale of lighting products. In conclusion, after speaking to our legal counsel, they have informed me that if CCL continues with their unlawful and deceiving practices, they are only setting themselves up for a class action lawsuit, which would include the list of customers that have complained to our office regarding their negative experiences with CCL. I am prepared to move forward with the requests of our legal counsel and will not hesitate for a split second to ensure that any company that is not operating in a legitimate matter be handled accordingly in a court of law.
