First Texas Homes seemed like they were a decent builder. I didn't know much about them but I realize now that no one should buy with these people. I signed a contract to purchase an inventory home in the villages of spring lake, mansfield texas. My wife is expecting June 29th and we wanted to upgrade space and location. The home seemed large enough and nice enough as did our salesperson.

We decided to sign a contract to purchase the inventory home on 4/4/07. They asked for a $4000 deposit which I paid on 4/9/07. Also, to increase the price to take care of some of the closing costs, I paid them $200 for administrative fees. We weren't able to close on 4/19/07 due to problems with the buyer of our current home who was affected by the suprime market turn and as a result was not fully funded to purchase the home using the current loan supplied by an outside lending company. I asked for the deposit money back. They denied it saying that I did not meet the 30 day (build) / 10 day (inventory) requirement for a refund. My salesperson told me that I could get my deposit money back in 30 days if the deal did not go through.

Needless to say, I was angry and believed this to be extremely unethical...but I still liked the house so I thought that if we could seel our house we would let them hold it until ours sold and could still do business. Later, I then asked for the $200 back, that too was denied. Explain this to me. How can I pay for the cost of the home to be increased when the deal did not go through for the house to be sold at the agreed upon price? I am now furious and have sent a letter demanding my money back. I have also called repeatedly. They have not returned my phone calls nor responded to my letter. The next step is legal action.

DO NOT PURCHASE A HOME FROM THESE GUYS OR PUT DOWN ANY DEPOSIT MONEY. THEY WILL NOT RETURN YOUR MONEY TO YOU - THEY WILL MAKE UP REASONS TO KEEP IT, ESPECIALLY NOW. I WELLCOME ANY CALLS FOR CLASS ACTION.

Somewhat resolved. FTH Trying to get better.

It appears that sites like these and our complaints are making a difference. I recently was told that I would recieve half of my deposit money back. I was hoping for all of it but consider myself fortunate given the history of all builders, let alone FTH, concerning this matter. The business manager was helpful, respectful, and delivered as promised. There is hope.

Update 6/6/07 My wife went up to FTH and made contact with one of their reps to try to get all or part of my funds returned. She agreed to have accounting return the $200 (rightfully so) but says she must ask the president if we could get back all or part or the rest. Right now he is out of town till next week. She contacted me so I guess that is a start. She says that we can't get all of it back - maybe half to cover time off the market (20 days) + taxes. Next week I will know something.
