Dissatisfied with Ford Credits actions taken against my account during the September 2006, October 2006 and November 2006 billing cycles, and hereby requesting credit relief from these actions,

Please let this letter serve as written complain regarding a report of loan default (32-day late payment) by Ford Credit, PO BOX 54200 Omaha, NE 68154-8000 on my Ford credit account # 038932XXX.

For the purpose of my complaint, Ford Motor Credit, located at PO BOX 54200 Omaha, and NE 68154-8000 will be referred to simply as Ford Credit".

For the purpose of my complaint, Bank of America, N.A. located at 100 North Tryon Street, Charlotte, NC 28255 will be referred to simply as "Bank of America".

For the purpose of my complaint, Pines Lincoln Mercury located at 14800 Sheridan Street, Pembroke Pines, FL 33330 will be referred to simply as "the dealer".

Relevant Loan Numbers: 038932XXX

Prior to making my September payment to Ford Credit account 038932XXX, I was notified by Bank of America that I was no longer the true account holder. Upon my own investigation, I confirmed that Experian, Equifax and TransUnion credit agencies noted that the primary account holder was a Mrs. X located at XXXX SW XXXth Street, X, FL 33156, telephone 1-305-XXX-XXXX.

I contacted Mrs. X regarding the matter immediately. She and I both confirmed with Ford Credit that she was the true account holder using the following methods:

1) Ford Credit's automated payment system at 1-800-727-7000 using Social security numbers XXX-XX-XXXX and XXX-19-XXXX.

2) Ford Credit's Website at https://www.fordcredit.com/.

2) By speaking to several Ford Credit representatives between the dates of September 19th, 2006 and October 25th, 2006 and innumerable times between at 1-800-727-7000.

In fact, during a "three-way" telephone conversation with a Ford credit representative, Mrs. X, and myself; Mrs. X requested that I held payment on the account until it was determined where the funds would be placed. This agreement was made under the supervision and verbal approval of the Ford Credit representative on the line on October 23rd 2006.

On October 25th, 2006 I contacted the dealer at which I purchased the vehicle. I obtained a copy of the contract [enclosed] which as noted, Mrs. X does not appear; proving that the error was made on Ford Credit's behalf and not error of the dealer. This information was forwarded to Ford Credit on October 25th, 2006 and per the recommendation of the dealer, I allowed automated payment to be delivered to Ford Credit on October 25, 2006, in good faith that Ford Credit would soon rectify the discrepancy and would properly distribute the funds.

Ford credit acknowledges the receipt of this letter, and notes this date in my account. No reference to Mrs. X has ever appeared on any statement, bill or notification from Ford Credit throughout the entire history of my account with Ford Credit.

Consequently, Ford Credit reported the September Payment as 32-days default in direct violation of Section 623 of the Fair Credit Reporting Act of 2004, despite the ownership errors and payment agreements made on the account by Ford Credit.

Ford credit refused to neither accept responsibility nor admit the existence of the ownership error until January 19th, 2007 where I received a letter dated January 16th, 2007 [enclosed] finally mentioning the existence of the error but still denying the request to have the late payment report removed.

To date, my Ford Credit Account still appears as defaulted and in "joint" status under Experian, Equifax and TransUnion credit agencies. I have written numerous complaints to all three of the above mentioned agencies, each of which confirmed with Ford credit that the account is at least of "joint" status and some report as 30-day default [enclosed].

Since September 2006, I have been applying for both student and home mortgage loans, many of which have been denied solely because of this error. As such, this error has caused irreparable damage to my credit and current financial status to this day.

Please note a written response from Ford Credit was received more than 120 days after my initial complaint of the error on September 19th, 2006 and is the first and only written response regarding this matter.

Please also note that no effort by Ford Credit has been made to correct this error according to Experian, Equifax and TransUnion credit agencies.

Not finding any faults other than Ford Credits lack of organization, action in offering a deferment during this period or effort to correct this problem, I would like to seek further action in having this September late payment be removed from the reporting credit bureaus.

Additionally, I may also seek full ancillary compensation from Ford Motor Credit Company for monetary losses incurred on my behalf by this reporting. This may include monetary losses due to credit denial, postage fees and/or expenses paid for attorney if required.

Having no other 30-day late payments with Ford Credit or any other crediting agency, I urge Ford Motor Credit Company to govern themselves accordingly to ensure this error be resolved immediately. I look forward to your timely response and appreciate any efforts to help me correct this error.

Straw Purchase?

Cory, no this was not a straw purchase... I didn't know people did those purchases for vehicles, usually these pertain to firearms no? Anyway, Mrs. X is a person of the same last name in the same zip code, she does not appear on ANY the title information, which is the basis of my complaint. If she did, then there would be a different course of action. Mrs. X only appears in my credit information. Proving to be an error solely on Ford Credit's behalf. Ford Credit was aware of this problem in September of 2006, however continued to report my account as "joined" through January 2007, in violation of Federal law. Please let me know id this makes sense. Thank you.

Who is Mrs X to you? Is she a relative by chance? How did her name even come up on the title? Was it a "straw purchase? Did you get any paperwork from ford? Also kind of odd to be getting a student loan and a home mortgage at the same time.
