I purchased a vehicle, 1998 Toyota Van, from Chapman Chevrolet on the West Side in Phoenix Arizona about 8 years ago. I took it to be repaired for a gas leak within the 30 day warranty period and the service department said they couldn't find a leak and they couldn't smell any gas inside the vehicle. I actually took it in twice, the second time so it could be checked by the service manager who was not there initially.
Some time later I had my 6-year-old daughter and my 3-month-old son in the vehicle with me after work. The van caught fire on the freeway after a man in the vehicle in front of me threw out a lit cigarette butt. I continued to make my payments for several months when I went back to the dealership, Chapman Chevrolet, to buy another vehicle. The owner was surprised and impressed that I continued to pay and agreed to sell me another vehicle a Rav-4, and forgive the balance owing on the van or tack it on to the cost of the new purchase. The owner stated to me that I should pay the payment that was due that week but that I wouldn't have to pay it anymore after I bought the Rav-4. I paid on the Toyota until after I purchased the Rav-4 from the same dealer because I was told I didn't have to anymore.
The dealership did not follow through with their promise to forgive the debt or make the pay-off or they neglected to advise the Franklin Capital. I will forward this letter to both Chapman Chevrolet and Franklin Capital to find out if this issue can be resolved.
