On 12/10/2009, I was extended a short sale settlement agreement by Franklin Credit with a promissory note of 60 months payable in the amount of $170.84, with an initial $1,000 paid to them at the short sale closing.  Now since the agreement has been in place, I have made three (3) payments in accordance to the payment schedule of the promissory agreement, however, FCMC is trying to collect past due monies from May 2009 prior to the short sale agreement.  They are applying the payments I'm submitting to the past due balance instead of against the agreed payback amount of $10k, which is realistically, a breach of the contract.  I have contacted them on several occasions, and I keep getting different stories from different customer service specialists.  The impact is they keep reporting me past due almost $2k every month to the credit bureau agencies, which is inaccurate.  On top of that, I'm going through a TS clearance background investigation and the information that they're providing is inaccurate.  I feel like they're trying to rip me off for the short sale, and they are ONLY THE SUBPRIME LENDER!!! I really want to take these people to court and sue them for all the negatives they have caused! Is there anything that I can do! I'm frustrated and need help!!!
