SUMMARY OF ARBITRATOR’S DECISION

Complainant Freedom Chiropractic, P.C. (the “Complainant”) has challenged the truthfulness of certain specific statements (each, a “Statement”) posted by Author Anonymous (the “Author”) on the Ripoff Report website at www.ripoffreport.com, on May 5, 2006, identified as Ripoff Report No. 190113 (the “Report”). The Author accused the Complainant of excessively charging for chiropractic services. The Complainant denied all accusations. The Author did not submit a response to the Complainant or any contact information. Therefore, in accordance with the Ripoff Report VIP Arbitration Rules (the “Rules), the Author waived their right to participate in this Arbitration.

 

In accordance with the Rules, the Arbitrator was asked to decide whether the challenged Statements were an opinion or a fact. If, and only if, the Statement was determined to be a statement of fact, the Arbitrator was asked to further decided if, by a preponderance of the evidence, to determine if the Statement was true or false. If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.

 

In this case, the Arbitrator had only the evidence submitted by the Complainant to consider. The evidence submitted included Ripoff Report #190113, Arbitration Statement provided by the Complainant, several Witness Statements provided by the Complainant, and several supporting documents and letters provided by the Complainant.

 

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author did not provide a response to the Complaint.

 

The Arbitrator determined that the statements challenged in the Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

The negative postings about Dr.Kells reek of "sour grapes." I've had back and neck problems periodically throughout my life due to two childhood horseback riding accidents and a bad car accident. I began going to Dr. Kells, along with two of my children, after my car accident about six years ago. The treatment program worked very well (and quickly). She's not only a genuinely caring person with a sincere Christian faith, but she's the best holistic chiropractor I've ever gone to -- whether in California, Michigan or Colorado. Her fees are very reasonable; and she works with people on tight budgets or who are unemployed. My teenage and young adult kids love her, and so do I.

My family has been adjusted at Freedom Chiropractic for nearly 6 years. Dr. Kris' treatment has changed the lives of my husband and son, who suffered from severe neck/back pain and migrane headaches.This office has gone out of its way to help us.  In addition to the 5 regulars to the office, I have 3 older daughters who have had problems from time to time and Freedom has seen them without even having appointments.

As far as cost goes, the pricing is very reasonable. We did use insurance and never saw any problem with the billing. Now we pay out of pocket and get discounts for each member of the family that is a patient. There has been more than one time when all our paid visits were complete and the doctors just kept adjusting us at no fee. (They were waiting for us to make a reevaluation appt.) I cannot say enough positive things about Dr. Kris and her staff.

Me and my family have been going to Dr. Kristen since September of 2005, and none of the information here is true at all. Because of her, my mother (who has been in a wheelchair since I was 4 years old) can now walk. My nephew was taken off of insulin and I have stopped using my thyroid medicine all thanks to Dr. Kristen's care.

We also know quite a few families who could not afford her care nor were they covered by their insurance to go - Dr. Kristen was more than willing to work out a care plan for them and work with what they could afford.

As for the statement that she does not spend time with you to answer questions - that is not true at all. Dr. Kristen is very good at making sure you understand everything and you get your questions answered. She also takes a few moments during every adjustment to ask you how you're doing and what's new in your life.

Dr. Kristen cares about her patients more than any doctor I've ever met. She is very sweet and caring, and most importantly she doesn't do it for the money at all. If you try to thank her or give her credit she says it's all God's work, and it's all thanks to Him. She is one of the most humble people I know, and it really upsets me to see her talked about like this.

Our family has experienced so much healing at Freedom. There are many people who have been ministered to by Dr. Kells and been freed from long term pain. I am a witness that she not only will work with those of us that don't have insurance, but is very patient when our payments are slow and late. Yes, Chiropractic service is expensive, but her prices are fair in the industry. Leana, you may have had a misunderstanding with Freedom, but everybody that I know that goes to Freedom testifies to the amazing work that Dr. Kells is doing. Go check out Freedom for yourself, Jim

My family has been going to Freedom Chiropractic since December of 2006. I had chronic asthma/allergiy problems and my son had been ill for 5 1/2 months. I also had trouble sleeping and chronic pain in my neck and shoulders. My husband often had his back "go out" for 3 or 4 days usually a couple of times a year. I have found their care to be wonderful. They know us by name and have set us up on a payment plan that is much cheaper than paying by the visit. We could simply not afford care any other way. My children are now off all allergy/asthma meds and are well. My once sick son is gaining weight and happy. I am breathing great and getting a good night sleep and my back and neck pain are steadily getting better. I appreciate that the appointments don't take all day, but also feel that the consultation appointments are always available to talk more in depth. You can schedule them at any time. I have had to call the emergency line several times when they were closed and Dr. Kristen has even brought her children to the office to wait while she adusts us with out complaint or an extra charge. I find that to be going beyond the call of duty. I have never in my life had such a great experience in a doctor's office. I have talked to so many of the other customers in the waiting room and they all have glowing reports as well. I find it funny that "all the people" who keep complaining about Dr. Kristen in this report keep spelling Colorado wrong. COULD IT BE THAT IT IS THE SAME DISGRUNTLED EMPLOYEE THAT IS WRITING OVER AND OVER AGAIN? DID ANYONE THINK OF THAT? Please don't take the complaints at face value because they are just plain wrong. My life is forever changed by this one woman's life and I am beyond grateful.

There are several points within this 'report' that I know to be misleading, wrong-headed or patently false and in all good conscience can not allow to stand without a factual rebuttal; 'Rippedoff': >>"...include charging insurance companies for treatments that never happened and falsifying records."<< On more than three occasions in the past; I have gone to Dr. Kells office, signed in, sat down and before I could be adjusted ran out of time where I had to be elsewhere and left without notifying the receptionist... NOT ONE TIME was my insurance company or myself billed for any of them. In fact, Dr. Kells or her office called me later to make sure nothing was wrong. Obviously, if any false billing was taking place it surely would have happened then. AND maybe you could offer something other than accusational emotion to persuade us? -------------- 'Rippedoff': >>"...(everyone, according to Dr. Kells needs at least a year of care to get better)"<< Anyone who begins treatment by Dr. Kells is thoroughly instructed before any adjustments are made of exactly what they can expect from treatment and what is expected of them. Sports, traffic accidents and law enforcement has sometimes demanded a cost from me I would be paying for later and to assume that any doctor could put together what I've taken a lifetime to tear apart in less than a year is highly unreasonable if not irrational. Additionally, Dr. Kells takes scheduled, in-office x-rays and sets an appointment to go over them with you which completely documents and explains in great detail your personal progress or lack thereof... Any questions you have can be asked at that time because its one-on-one or you can set up an appointment at a later time with her to do so. What more could we possibly ask of any doctor? ( If you'ld prefer to go 'under-the-knife' for the promise of a 'quick-fix' and $20,000+++ taking an obviously serious and often irreversible risk, that's your choice. Yet, who hasn't heard of the horror stories of friends and relatives who have had operations which left them worse off than when they started? ) Therefore, this is starting to smell of something other than what this service is for...the reporting of intentional wrong-doing. You've posted twice so I'll ask you to provide some semblance of proof because I have seen nothing but the 'right-stuff' from this doctor. -------------- >>>"...Dr Kells will tell you that she doesn't do it for the money, but that she does it fro GOD."<<< In the past I have experienced excruciating pain from sublaxations in different locations of my spine inwhich Dr. Kells was able to find and adjust immediately without any explanation from me at all...Dr. Kells has consistently demonstrated this expertise on numerous occasions and she is the fifth chiropractor that I have seen in the last thirty-some years...Meaning, this isn't my first rodeo and Dr. Kells is the best of any I have experienced. ( I have also heard other patients offer similar remarks while waiting to be adjusted. ) I don't care how she derives her personal motivation or contributes her skill to as long as I am better than I was and I continue to improve when I follow her guidance...I am and I do. Again, this is clearly an emotionally charged personal attack made about the doctor and so far is without any offered proof or evidence. I know Dr. Kells to be a true professional in every sense of the word and if you wish to persuade me or anyone else to the contrary you'll provide what I've reasonably asked for...AND if you believe what you say, why hide behind an alias? ---------------- Response to Alan - Saint Paul; I'm amazed at how quickly you've dismissed efficiency and competency for "cult-like" greed. I'm not religious at all yet I know she's the best I've ever had the pleasure to be treated by. Perhaps, you should find out for yourself why they are so good. ------------------ Now my previous suspicions are enforced by the next post: Leanna from Colorado Springs. Leanna I know personally. It is highly probable that she is a very disgruntled ex-employee and I wouldn't be surprised if she orchestrated this initial rip-off report or authored it due partially to the evidence that the alias "Rippedoff" date of filing here was 5/5/2006 and Leanna's "response" was a mere five days later ( 5/10/2006)... that's just 5 days folks! What are the odds of that? Would someone suggest Leanna cruises the Rip-Off Reports on a weekly basis for just such an opportunity?...Hardly eh? Therefore, I strongly suggest the editors of Ripped Off look into the not so 'coincidence' of the filing dates and their respective authors...IF different and this is not the personal attack this 'report' certainly appears to be, lets see something besides emotion so that those of us who know better are informed...OK!?

They usually are having "health Fairs" at your local mall or street fair. Once they get you into the office you will get an x-ray, MAYBE an adjustment and have you come in the next day. They will then say, that you definitely need care, and your insurance will most likely not cover it, or only part of it. You said it corectly in the begining, "ripped off". 3000.00 for the year should cover it. These guys are VERY GOOD at sales, not necessarily at Chiropractic. They went to a long and expensive seminar on how to sell chiropractic to the masses. Their big selling point is this... "Do you only want to just get out of pain, or do you want to reach a new potential in your wellness?, or something similar. It is a loaded question, making it very hard to say the first answer. Anyways, it is unethical to expect to come in the amount of times, esp, since you paid in advance or signed a contract. Remember, just because someone claims to be a Christian does not necessarily mean they are one. Watch for their works, not their words. Only God Himself knows about Dr. Kells

I am a chiropractor and it makes me ill to see the lengths some chiros will go thru for patients. I have been looking for an associateship position and I came across her ad. She is a member of a practice mgmt. group called "Body By God". And that is how she is seeing 750 patient visits per week. She is not operating a chiropractic clinic, she is operating like a cult. I hope this helps you understand what she is doing.

I do not know this Chiropractor, but the whole thing does sound a little shady. I am sure there were very strong and successful sales tactics to get you and keep you at least for a while. Try to understand that there are ethical DC's out there that do whatever they can to help people, and if they cannot, they send elsewhere. There are, as in every profession, bad Chiro's....something to look out for. 1. Never go to a DC you met at a mall(They pay A LOT to reserve a spot in the mall and will do anything they can to CLOSE the deal.) 2. Avoid the big ads in the Yellow Pages. 3. Avoid the ones that say they save lives. 4. Never go to one that says a years worth of care, IE. 3X/week for 3 months, 2X/ week for 3 months....whether you are in pain or not. This is a SCAM SCAM SCAM! 5. Never go to a DC who insists on you bringing your whole family. 6. Never go to a DC. offering a free first time vist(since when has a dentist offered that? 7. Most importantly, go to a Chiropractor who is a referral from a close friend. You will be more apt to trust them with your body and they will produce the desired results faster that way. Whew, I'm tired, but I do hope this helped.
