Even though all the reviews online with negative remarks about FX Logistics was against them, our company decided to give them the benefit of the doubt. Our factoring company even rejected to purchasing their invoices becuase of issues. It all started with a lady named Julie Payne who is a dispatcher. We really liked her and put our hope into her. She starts off very nice on the phone when booking (especially during the holiday mail season) but when it comes time to get paid she freezes and says she has nothing to do with payments. Understood. So then we move on the so called "accounting" department and there are 2 people they say are in charge of it. One of them is named Raymond whether that is his real name or staged name. To date they have had many invoices from us that are 30 days old and we signed up for quick pay at a 1% fee for same day payment and still no payments.... Instead of sitting here and listing all the excuses they have come up with on why they won't pay you can use your imagination. Today we decided to go to their "address" in GA on all their paperwork and billing info to find there is office in GA. Very strange for putting this on all your literature and to find out there is no office in GA. So we try calling them and asking them if we were lost or confused about where they were exactly and they state they don't give out their "address"... haha. You wonder why maybe? You can use your imagination....

Their biggest excuse on delaying payment is saying you didn't send in the required paperwork for payment. This is once again a delay tactict used by them on most invoices. I assume cash flow issues is their main concern so why not just say they need more time to get payments in so they can pay their carriers instead of lying everyday? I will give them this... They did pay around half of the loads we did for them after pulling teeth. We are still out $20,000 and hope to see this soon but I am not in the business of being a debt collector but I guess that is what has to happen here in order to get paid. We haven't issued a claim on the surety bond or call the Post Office and hope it doesn't have to come to that. I even read on the internet they swap and cancel bonds all the time and I assume the reason is to hid from carriers filing on it? All we want is to be paid for the remaining money they owe us. Julie admitted she made mistakes on rate confirmations and accounting was going to fix it on their end so they could pay us. 30 days later its not fixed and 30 days later of emialing this Julie character no answers... Very sad their are brokers out there that screw people over and its just not fair. I hope FX Responds to this posting with whatever excuse they have now on why they are not paying. The bottom line is the issue has always been internal and their people including Julie have admitted it but yet nothing has been done. Scott, Leesa, Josh are also other names that we have been trying to get ahold of and no luck. Supposily Scott and Leesa are the owners. Just want to get paid and move on. We will not be doing business with this compnay in the future.

To correctly address this report, some background information is required. The first paragraph is in regards to December 2013.

 

Mr. Adam Brock was the owner of Tennessee Logistics that operated under the USDOT Number 2357974. While operating under this USDOT number Mr. Brock repeatedly submitted BOLs to us that had been whited out and handwritten rendering them completely fraudulent and counterfeit. We refused to pay these invoices as they were not hauled by Tennessee Logistics, but in fact hauled by dedicated and trusted carriers who not only ran, but also turned in the accurate and authentic documentation. Mr. Brock felt that our decision was distorted, so he decided the proper action was to file on our bond.  FX Logistics was rewarded the case upon providing the bills submitted and proving beyond reasonable doubt that the bills were indeed fraudulent and counterfeit.  Tennessee Logistics has since gone out of business.

Mr. Brock contacted our office again the very next peak season, interested in transporting postal loads. At the time we did not realize that it was the same Mr. Adam Brock that owned Tennessee logistics and had filed on our bond with fraudulent bills just a year prior. Mr. Brock told our account manager Julie that he was a fresh carrier that had just started up a month prior with his wife Ashley. Mr. Brock was now operating under USDOT number 2311706, MC 789181 with the name Ashley’s Transportation LLC.  Still unaware of the true identity of the carrier, we set them up and continued business as usual.

During their round trip runs, we found out that they started running behind due running single drivers, as opposed to the required teams. Because they were late delivering their round trip, reloads were rebooked and already on the road due to the strict nature of the USPS pickup times. The post office would still load the trucks but the drivers failed to check their paperwork to confirm they were loaded with the correct loads. We did not pay the invoices for the wrong trips because the paperwork did not match the information listed on the rate confirmation as per our terms. (see below)

 

“*NO PAYMENT ISSUED UNLESS USPS FORM ISSUED TO CARRIER MATCHES THE PICKUP DATE, USPS CONTRACT AND TRIP NUMBER ON THIS RATE CONFIRMATION*CARRIER AGREES DRIVER(S WILL HAVE SUFFICIENT HOURS OF SERVICE TO DRIVE LOAD STRAIGHT THROUGH AND NO PAYMENT SHALL BE ISSUED OTHERWISE… CARRIERS MUST COMPLETE ALL USPS TRIPS FOR WHICH RATE CONFIRMATION IS ISSUED BY FXL…”

 

On one of the runs the Post Office changed the contract number during peak season. This change was noted and all runs done under the old and new number were paid in full to Ashley’s Transportation. Again, most of the trips they did would never match because they never picked up on time, ergo, they would not pick up the correct load originally booked.

 

Mr. Brock would call our office several times a day once he realized their paperwork was wrong and would continually ask about it after the load was fully delivered. He continuously troubled Julie telling her that we had made a mistake on the rate confirmations. Our contracts are built based solely on the plates sent to us by the customer and they were booked on specific loads detailed in the rate confirmations. Unfortunately, they did not follow the contracts they agreed to.

 

The phone calls and emails from Mr. Brock escalated to extreme magnitudes. His commentary became exceptionally disturbing and strikingly threatening. Mr. Brock had even disclosed his intentions of coming to find Julie if he was not paid. The threats stopped after our Vice President of Operations told Mr. Brock that he would contact the police and submit the emails that were sent to Julie as evidence of harassment.

 

Subsequently, Ashley’s Transportation was taken off the contract completely due to Mr. Brock’s threats and lies.

 

Likewise, Mr. Brock has filled bankruptcy, as the president, under Pat’s Transportation LLC that also dba (does business as) Ashley’s Transportation, Tennessee Logistics and others.  We would not advise doing business with these companies or Mr. Brock.

 

We stand by our decisions and welcome any further questions or concerns from Mr. Brock or his companies.
