3. Problem: Negligence and fraud.

We have relocated to India where I am helping develop a Family Medicine Residency in a Mission Hospital, and providing healthcare for indigent patients. We contracted with Globex to deliver our shipment of household goods and personal effects, and the original estimated delivery date was in August. We did discover that the goods arrived in Chennai port, India, in August.

Globex had been unable to secure payment of the charges, which we had already paid to them, until January. We have had to replace many of the goods in the shipment due to their unavailability, at considerable cost. Our goods sat in Chennai for 5-6 months while they accomplished nothing at making their payment to their incompetent Indian partner.

When the goods were finally paid for, after they finally switched to an agent with some degree of competence, our six month period in India had passed and we were required to leave the country for visa reasons.

Immediately upon return to India I cleared customs. Globex is currently refusing to pay storage fees for this time period in January. In addition, had the goods been paid for on their arrival to Chennai, by Globex, I would have had one month to clear customs prior to any storage charges being assessed. The existence of storage costs at all reflects negligence by Globes.

It is not my fault that they only managed to make payment for the shipment after six months, when I was required to be out of the country for visa reasons. . Had the goods been ready for clearance any time near their estimated shipping date, in August, I would have been easily able to clear customs.

Globex is also currently refusing to pay for shipment to our home in a provincial city--this is clearly stipulated in the contract as their responsibility. And they are likewise refusing to pay for customs clearance, also stipulated in our contract. They are playing with the terms of the contract to disguise their own obligations and evade their responsibility.

We were stuck in Chennai for three days just trying to exchange emails with them, paying significant costs for a hotel, struggling to care for two small children (ages 2 and 4) in unfamiliar surroundings, and I was missing work. In the end, after considerable delay, their only response was that they would remit no more.

I have repeatedly asked my contact person for information on her superiors and she evaded the issue, until last month when she finally did provide the contact info for her supervisor, Bella mentioned in my above complant, and said that she had provided this information on several occasions which was blatantly false.

We have also made phone calls that were never responded to nor acknowledged. They advertise a service they are totally unable to provide, and do not take responsibility for their failures.

We eventually paid some 745$ in inappropriate fees and charges in order to secure delivery of our goods, and these amount at least is clearly owed to us by Globex. As these were our household effects and childrens' needs, we have had to replace many of the items at considerable personal cost.

Doing business with them has made out life hell, and caused inestimable inconvenience, cost, peace of mind, and frustration. If I am unable to settle with them through forums such as these I shall be forced to take them to small claims court.
