Well after 4 months since I unsucessfully lost a claim for damages to my car. I am here to report that I still find leaks under my car. You can go to the internet and see a video of the leak. Conduct a search for green gifford.

After careful consideration and based on what I know now, I am retracting my statements on this website after a judge on my case believed I only had circumstantial evidence and dismissed it last June 14, 2006. And in response to the Tavss Fletcher letter I have received, please remove my statements. I wish to resolve this case peacefully and avoid any more legal action with Green Gifford.

Tavss Fletcher June 20, 2006 Dear Rex: As you know, I represent Green-Gifford, Inc. It has come to the attention of my client that you have posted several statements at different Internet Sites that are defamatory to Green-Gifford. Particularly, they have seen statements on www.ripoff.com and www.complaints.com. As you are also aware, the Norfolk General District Court dismissed you claims against Green-Gifford on June 13, 2006. Green-Gifford demands that you immediately remove these defamatory statements and any others currently posted from the Internet. Additionally, Green-Gifford demands that you cease and desist making any additional defamatory statements against Green-Gifford on the Internet or any other location. If these demands are not met within ten (10) days of the date of this letter, Green-Gifford will pursue all available legal remedies against you, I am, Very truly yours, TAVSS, FLETCHER, P.C. By: Marla J. Diaz Here's a question for Marla Diaz who represents Green Gifford. How did you get the claims dismissed on June 13, 2006 as stated in your letter. When it didn't go to court until June 14, 2006 at 10:30am? I was not aware of that. At the time these said statements were made. I was expressing an opinion and my right to freedom of speech. My statements were first hand experiences of what was happening to me at the time. I also had a duty to provide information I felt Nissan consumers should know so they won't have to go through the same customer service treatment. How a Green Gifford customer of over 15 yrs is being treated. A loyal customer whose family bought 3 Green Gifford vehicles. Nissan vehicle in question has been serviced many times at Green Gifford over the years. At my request, the statements at www.complaints.com were forwarded to Green-Gifford's place of business at the time it was created last March 4, 2006. Why did it take them June 20th 2006 to respond? Why didn't they act in stopping the messages in early March? Moreover, statements were made on ripoff.com at the same time. If Marla Diaz claims that what was written was defamatory: which particular statements or claims are defamatory and why? Presently, I do not have the authorization to remove my statements on this site. To this day, Green-Gifford Nissan has never conducted an inquiry onto my complaint why I found a puddle of transmission fluid under my car after it was serviced last Dec. 7 2005. A vehicle that never had a history of transmission leaks. Never have I been in the same room with the Service writer, the Service Leader or the mechanic simulataneously to discuss what happened to my car and receive straight answers about finding the cause or even asking what diagnostics techniques were used to explain the puddle has remained unanswered for nearly half a year now.

My vehicle is a 1990 Nissan Maxima that recently broke 100,000 miles which is pretty low for a 15-16 yr. old car in good condition. The car was repaired at a final cost of $831.02 for all services on December 8, 2005. The fact remains it was not a few weeks later but a few days later. I called Susan Dye my service advisor and told her I found a huge greasy puddle under my car. I told her my car was returned damaged. I used the words "Gushed out" as the severity of the mechanical failure I was experiencing. I specifically told her it did not look like oil. I was forced to pay another $48 diagnostic fee to find out why my car had a puddle of fluid under the vehicle. When I brought my car into the service department. I brought in samples of the fluid which was 8 pages of newspaper soaked with the greasy substance inside a ziploc bag. I picked up my car on Dec 13, 2005. And my Service Advisor Susan Dye tells me my car is not leaking. I asked her what about the puddle under my car. What about all the soaked newspapers I bourght in? She said my car was not leaking. Susan Dye told me that she and the mechanic didn't know what the greasy samples were or the reason the puddle was under my car. I refuse to do a song and dance all night long with me telling them my car was damage and Green Gifford telling me my Car is not leaking. How is this a few weeks later? Fortunately, I have the December 13, 2005 invoice to prove I did complain about my car being returned damaged. I did pay $48 diagnostic fee for first class service at a state of the art facility to find out why I had a huge greasy puddle under my car. Which we later learn is an expensive tranmission fluid repair problem eventually. The fact is, the repair work was guarenteed for 90 days or 4000 miles. I was within my rights to complain that I was still experiencing the initial problem back in December of a minor oil leak. Service repairs are guarenteed. The fact is I did come in to get my car fixed in February 22, 2006 because it was leaking oil like before. But this time I am told my car had been leaking all along. Now would a reasonalble person pay nearly $900 for auto services at Green Gifford and leave with the same oil leak problem with their car? I was told my car was not leaking whatsoever on December 13, 2005. Why can't a Nissan Master tech of 10+, 20+, or 30+, for that matter find the origin of a major puddle of greasy fluid under the vehicle back in December? Or have an answer to the soaked samples that were brought in a ziploc bag? The customer who is complaining of the damage should not be responsible for the problem when the car was not brought in that way originally. Yes, an aftermarket axle was placed in the car. But Green Gifford returned my car damaged. They couldn't figure out the leaking transmission they gave me after my car was repaird for a minor oil leak. Which is why I chose another mechanic to make any further repairs. The same mobile mechanic who is the main reason I spent nearly $900 on Green Gifford Servicas in the first place at his suggestion. Now Green Gifford is blaming new repairs I had done on January 19, 2006 on damage Green Gifford done to my car back in December 8, 2005. Does that make sense? I have no problem on the maintanence repairs that a car needs. But I'm not going to be blamed for the damage to my car back in Decemeber 8, 2005. Yes I hugged Susan Dye, I have no ill will towards her. She is just doing her job. But it does not mean I should accept my car being returned to me damaged. Any customer would just be plain happy to have a car returned fixed. Which should have been done the first time around not after a third or forth time. Well 2 months did go by, but not without action because the Better Businees Bureau was not able to resolve my dispute with Green Gifford. A letter was written to the BBB 3 days later. So the Department of Agriculture and Consumer Affairs for the Commonwealth of Virginia was contacted immediately in early March 2006. Instead of clogging up the court system I was hoping to go through Alternate Dispute Resolution. I was hoping to go through mediation or arbitration to help resolve my dispute with Green Gifford. But Green Gifford was not willing to take that route. When my Dispute Resolution Specialist named Tina tried to contact them by phone on what method to finally take to resolve this. I was told by Tina that nobody was returning her phone calls by late April. The timeline for ADR is usually 60 days. Green Gifford needs to treat a person who has been a cusotmer for over a decade better than this. It's unfortunate it had to end this way because I was a really proud customer at one time. Mistakes happen, but there has to be a better way then blaming the customer and everyone else but Green Gifford. Seriously folks, I was refunded $48. Lets not forget I came in with a $500 oil leak repair job. ( not counting the nearly $300 part for window that was an impulse repair) and I came out with another $1275.53 to fix inital leak and the damaged caused leak with the warrenty repaid period. I already spent nearly $900 the first time around for auto services. Where was the no fees charged on the problem? I paid another $1275.53 in repairs. Yes, some required maintanence. But the damage transmission repair of nearly $1000 was the damage I complained was given to me back in December. No fees charged? I don't think so. The vehicle was returned damaged and the customer is faced with the payment. Not good business practice. And yes, I have pictures of fluid still under my car to this day. Stains and drops that is unexplainable and they look like oil and transmission fluid. Does it matter if my car is 15-16 yrs old. I paid for first class service.

The customer did come in for an oil leak several months ago, on a 20year old car with 100,000+ miles on it. It was explained to him that there may be several things leaking on a car that old, so the first step was to start at the top. We replaced the valve cover gaskets, cleaned any residual oil, and the customer was on his way. A few weeks later, the customer returned complaining of an oil leak. Was told that the oil pressure switch and the rear main oil seal were leaking slightly by a Nissan Master Tech of 30+ years. He was also informed that his CV axle was damaged. The customer declined repairs at that time, citing the holidays. Several months later, the customer returns. He is complaining of a Major leak. The Service Manager sets up an appointment to go over the car with the customer. Mr. Powell takes the customer into the shop and shows him exactly where his car is leaking!! Customer was told transmission axle seal is leaking, possibly due to the after market axle that had been installed by another repair shop. The customer was advised to take the car back to said shop and have them fix their mistake. At that point, he was also given an estimate for everything the rear main, the transmission seal, etc. Customer ok's repairs. Halfway through the job, the customer comes in, sees the transmission out of the car and decides he doesn't want the work done anymore. He was told that wasn't a problem, just pay for what has already been done (1/2 the job), and call a tow truck to remove the vehicle. Customer then decides to let the Tech finish the job. When he picks the car up, he hugs the service writer, happy with the work that's been done. 2 months goes by, and we find out that Customer is taking Green Gifford to court. He was refunded the $48 diagnosis fee for the oil leak inspection, and received numerous visits to the shop with no fees charged. What more does he expect?? Does the car still leak?? Obviously it was fixed.
