I completed and signed the official Medical Records Release form and gave it back to the Hospital on 11/29. The following day (11/30), the Hospital confirmed that it had received my release form.

HealthPort mailed an envelope and it included six pages dated 12/5/2011. HealthPort wrote that it is unable to comply with my request for medical records because HealthPort states the authorization was not signed by me, the patient (even though it was)! Here is a copy of the letter's text verbatim:

From: HOSPITAL/HEALTHPORT

Re: Authorization not signed by Patient
Medical Records Request for PATIENT

Dear PATIENT:

We are unable to comply with your request for medical records for the following reason(s):

The authorization was not signed by the above mentioned patient. It is the Hospital and HIPPA policy to request supporting documents, in the event the patient is unable to sign for the release of their medical records.

If the Patient is deceased we need Probate Court documents.

If the Patient is incapacitated we need the Power of Attorney Documents. Either document must list the individuals who signed the release form in the absence of the patient?s signature.

If you should have any questions please contact us at PHONE NUMBER."

HEALTHPORT HAD SENT THIS TWO-PAGE LETTER ALONG WITH FOUR OTHER SHEETS OF PAPER.

The first paper was a coversheet from HealthPort with an apparently personalized bar-code. (It appears HealthPort saves an image of all records it mails out for legal reasons). THE SECOND PAGE WAS A COPY OF THE ACTUAL RELEASE FORM WITH MY SIGNATURE ON IT! The third and fourth pages were the above-mentioned form letter regarding "Authorization not signed by Patient." The fifth page was a blank release form. And the final page was a receipt.

PLEASE BE AWARE THAT HEALTHPORT MADE A PHOTOCOPY OF MY ORIGINAL RELEASE FORM (THE FORM WITH MY SIGNATURE ON IT) AND THEN MAILED THE COPY BACK TO ME BUT CLAIMED I NEVER SIGNED IT EVEN THOUGH YOU CAN SEE MY SIGNATURE ON THE PHOTOCOPY OF THE RELEASE FORM!

Therefore, what is really going on here? Something else must be going on because you can see my signature on the *copy* of the release form which, as I mentioned above, was mailed directly back to me, the patient, at my home address.

In all, HealthPort states the medical records authorization request was not signed by the patient. But then who does HealthPort think signed it? Please explain.

Moreover, please be aware that I made a videotape of opening the envelope which HealthPort had dated 12/5/2011. Therefore, I have video-graphic evidence of all the above-mentioned.
