We are in desperate need of help. Our home was damaged by hurricane Rita, but we had TW&H policy in escrow. However, our escrowed TW&H policy was not paid and coverage was cancelled. We were notified of this the day the state placed a freeze on all new accounts, just prior to Rita's landfall. Our home is located in Groves, TX. It was severely damaged, and remains unihabitable.

Homecomings Financial GMAC is the lender and was the one responsible for maintaining the escrowed policy. They were 10 months late in payment, and sent it about 4 days before Rita hit Jefferson County. Regardless, the payment was too late to cover Rita's damages to the house.

After many phone calls & denials, they took repsonsibility and had their own adjuster go the home, on 10/29/05. They were issued a check and released some money for us to get a roof, about a month ago (1/2006). They have since been given more money, as the damages are tallied, exceeding $40,000.00.

We continue to lose money, as it was rental property, and they still refuse to give us any more money for repairs. They have release only $9000.00, 1/2 of what was asked for by our contractor for immediate roof repairs, to date. Regardless, the contractor has done 75% of the requested repairs, and has still not yet received more compenstation.

We were told, by Homecomings, all repairs and past house payments are to be made before they release the rest of the money. This is impossible, as we cannot lease out the house without repair or repair the house without money. This money they continue to sit on & collect interest on!!

Our policy was cancelled because of them and the fact that they have drug their feet throughout the entire process has piled up debt on our backs...sd they keep piling it on us! Mold has since spread throught the entire 2100 sq foot home!! Prior to the storm it was appraised at over $115,000.00, now it is worthless & they will not give us our money for repairs!!

WE do not know what to do...they aren't willing to negotiate and consider what they are doing as a favor. Please help us. Our patience is completely gone and has been abused by these crooks!!

i was only tring to help like you i to was a SCREWED OVER BY GMAC and yes i dont know a thing about texass law and i dont want to so if you are offended by what i was asking thats just to bad after all i am only a fool and i still dont belive you didnt know when your insurqance was due and that you didnt pay it even if you knew the mortgage company was escrowing your monies i know when mine are due and iam sure that a lot of other people know when theirs are due after all we have investments in our homes its called good bussiness practices and chris dont bother anwsering this it will only make you look bad

One thing, Daniel...it was an additional policy handled by my agency. THe home in question is located in tier one of the Texas coastlinbe, therefore the only twh coverage offered is throught the state....not my homeowners policy. Since the policy is inactive, the problem is not twith them, but the people that were being paid the money and sent the bill....Homecoming Financial GMAC. Homecomings had the policy in their system as an active acount...assuming their insurance/escrow dept. had paid their bills. Yes, if I would have been notified I would have taken care of it sooner..but, since they apparently did not want anyone to know that they were not doing their job, they did not tell me they were stealing money and waiting until absolutiely necessary to pay for the policy...so they could collect interest, maybe...WHO FREAKING KNOWS. Only a fool like yourself would blame their foolish oversights on the victim. I suggest you educate yourself on Texas insurance, mortgage & escrow laws and reread the specs of my case before you come at me like some kind of uneducated defender of the coporate bullies. Yes, I have contacted TDIC, and TDIB, through the T.A.G.'s office as well as BBB, and I am in the process of beginning litigation. This posting is not the end of the road regarding this pending suit. Sorry you are too shallow and dense to understand this is not a realy forum to solve disputes, but only to get the word of about crooks. For anyone thinking about dealing at all with these crooks...DON'T!!

chris you need to start reporting this to the proper gov offices hud ,respa ,the banking commish in your state and the insurance commish office also if you read throught some of these other stories you will find the info in them about who to speak to oh and chris why did you wait 10 months to figure out you didnt have insurance i know you say they were escrowing it but you should have covered you own butt in this case
