Sample of a letter that we sent

This letter is an official complaint in reference to the above mentioned Mortgage Company. I purchased a ranch style home in 2003 for $140,712.80 because my fianc' (Julie Fritz) suffers from MS and we were living in a town house with steps. My original mortgage company was Decision One Mortgage at some point and time Homecomings became our mortgage company, there was not a refinance.

Over one year ago my fianc had to quit work due to her MS symptoms and the treatment regimen she was on (chemotherapy and a daily injection). At that same time my ex wife (whom lives in CA) hearing I purchased a home decided to quit her job and take me back to Court for an increase in Child Support. Through Riverside California Superior Court my child support was raised to 823.62 a month. The counted her income at only minimum wage. The Judge would not take into consideration that she quit a 70,0000.00 a year job to stay home because her fianc (now husband) earns well over 120,000.00 a year.

Our financial bind began. Some payments were missed but when 2 payments were sent they were returned. While Julie fought for her disability, I was fighting for a new Court date in CA. Since then Julie now is receiving her Social Security benefits and I had a new Court date which reduced my monthly child support amount. Which on August 18 of 2006 that amount will be reduced again, due to one of my son's turning 18.

The problem began trying to deal with Homecomings during this financial difficulty. I signed a release of authorization paper so that Julie would be able to try to deal with this problem. The individual contacted were as follows: Ken Spindel - GMAC Enterprise Risk Officer, Mike Kozlak GMAC Residential Capital Group, Bruce Paradis GMAC President (all with the GMAC executive offices in MN), Rosemary Love Executive Correspondent, Rachel Roberts Homecomings Financial Account Manager, and Arthur Calhoun Homecomings Loss Mitigation Specialist. The first was contact with the executives was in early May. Rosemary Love contacted her for the executives and she contacted Rachel Roberts. Ms. Roberts sent a form to be filled out and it was faxed back to both the GMAC office in MN and the Homecomings Office in TX. I heard nothing from them but then received the announcement of the Sheriff's Sale on 8/22/05. Again Mr. Paradis, Mr. Kozlak, Mr. Spindle, and Ms. Love to try to work out a payment plan. Then we received same forms again to fill out from Mr. Calhoun, they were filled out and returned again via fax with wage documentation.

Mr. Calhoun, Ms. Love and Julie spoke back and forth many times and they both made it really seem we could come to an agreement. During this time I also received a letter that my interest rate was being raised from 7.99% to 10.99% (that letter was received on June 20th, 2005). Finally on August 19, 2005 three days before the Sheriff's sale Mr. Calhoun told Julie an agreement could not be worked out, she then requested an extension on the Sheriff's sale (to have a little time to refinance) and Mr. Calhoun stated they couldn't do that either. At that time he said if we come up with $13777.55 before the sale we could save our house or come up with the refinancing a payoff amount was requested at that time. Today 9-2-05 a pay off letter was received from Mr. Calhoun for $155,662.57. At the time we purchased the house we only paid $140,712.80.

Please investigate this manner. I would also appreciate if you could contact Homecomings Financial and stop the sale until this manner is fully investigated. If the sale was suspended we have another Mortgage Company that said they could finance the house but that finance amount was only thought to be about 141,000.00. We have to contact that company now that the pay off amount was received.

PS I just received another letter from Homecomings Attorneys the new pay off is now at over 156000.00. I will be once again writing to all authorities mentioned

Anyone with a problem with Homecomings needs to write to Jayme Brown Division of Financial Institutions Office of Consumer Affairs 77 South High St 21st Floor Columbus, Ohio 43215 They are currently investigating them and need all the information they can get. DON'T GIVE UP. WE CAN WIN AGAINST THEY PREDATOR'S!!!!!!!!!!!

Hello,we are battling a huge battle with homecomings right now...and wondering if u recieved any satifaction from the headquarters of Homecomings??? We have written many attorneys,and wondering if i should send a copy to the headquarters of homecomings to inform them of the wrongful doing in the DFW office??? We are about to completely lose our home due to one person at homecomings that did not do their job and admitted it..but just apolgized and said sorry,i cant do anything about it now!! UNEXCEPTABLE! We are fighting this to the very very bitter end...it will be a cold day in hell before we left homecomings win this battle!

i dont want to discourage anyone out there from doing what julie has said(WRITING TO THESE GROUPS) but i have been dealing with gmac and these gov offices for almost two yrs now i can tell you this they do not give a rats a*s about this problem its going to take all of us and this web site to bring this company down so keep telling your friends and familys about gmac and how they are dont buy their cars, trucks or do any financing with them

UPDATE ON PERSONAL STORY WITH HOMECOMINGS Upon doing some investigation it has been discovered that Homecomings Financial purchased the home that they foreclosed on for a purchase price of 115,000.00. The same property appraised at 160,000.00 in 2003. There was a lady at the Sheriff's Sale bidding on the home but was told by the Homecomings Representative that they would out bid her and to give up. DON'T FORGET TO GO TO CONSUMER COMPLAINTS WEB SITE AND FILE COMPLAINT THERE.

In addition to writing to your state agencies and representatives also write to federal agencies. I have written to the following federal agencies as well as my state. Street NW Washington, D.C. 20552 Alphonso Jackson, Secretary US Dept. of Housing and Urban Development 451 Seventh Street SW Washington, D.C. 20410 (He is a member of President Bush's Cabinet) This is a copy of the letter that I wrote: Dear, This letter is a desperate plea for immediate assistance in a matter that has affected not only my family but also thousands of families across the country. Currently, my husband and I have a mortgage serviced by Homecomings Financial. We have had numerous problems with them concerning the improper application of payments, exuberant fees, and missing payments. We have written letters requesting an itemized accounting of our loan to include all transactions. To date, Homecomings has denied receipt of any such letters. The last letter sent, dated September 15, 2005, was certified return receipt requested. We are aware that others have had similar difficulties with Homecomings. In January of 2005, Homecomings settled a lawsuit initiated by the Attorney General of West Virginia. These complaints detailed the charging of illegal fees which caused some homeowners to lose their houses in foreclosure. On October 10, 2004, Gregg Hammond of Orleans, Michigan received a judgment, file number 03-M-22667-CH, in the Circuit Court of Ionia County which ordered the immediate cessation of foreclosure proceedings, and the correction of credit reports, along with an order for Homecomings to supply Mr. Hammond with a full accounting of his loan. In addition to these court cases, Kurt Eggert from the Chapman University School of Law wrote the article, Limiting Abuse and Opportunism by Mortgage Servicers, which was published in 2004 by Fannie Mae Foundation in the House Policy Debate, Volume 15, Issue 3. In this report, Eggert cites instances where servicers misapplied payments, charged excessive, false, or unwarranted fees, and submitted inaccurate payoff amounts. We are in a similar situation. To date, Homecomings has charged us with $12,000 in corporate advances which we have yet to receive an explanation as to the nature of those advances. In addition, there are a multitude of fees added to the loan of which there is no explanation. Also, there are many payments that are missing. We have been unable to get any explanation or resolution to these issues. Recently, Homecomings started foreclosure proceedings against us. We have filed a Chapter 13 to stop the foreclosure but since Homecomings has been successful in getting Relief of Stays in the past, we fear that this is only a temporary solution. We are requesting your assistance in dealing with Homecomings Financial with the following: 1. Obtaining a full and complete accounting of our loan so we can address the issues of missing payments and charged fees. 2. Elimination of those fees that are unwarranted or are in direct violation of Washington State and Federal statutes. 3. Obtaining an agreement with Homecomings for a payment plan to bring current the loan after the aforementioned items are addressed or an agreement that a Relief of Stay will not be pursued allowing us to continue with our Chapter 13 plan until the loan is once again current. We understand that you are very concerned about the welfare of the American citizen and will do all that you can to help. As this is an ongoing issue with Homecomings Financial, we hope that an investigation into the accounting practices of this company will be initiated to prevent any other homeowner from experiencing this nightmare. Respectfully, I hope this helps. If we all write, we will be heard!!!
