Your situation is alot like ours. We have been trying to get some kind of statement of our account from Homecomings for over a year. Now all the sudden they sent a forecloser notice saying we owed payments back to 2002. They applied our May-Sept 2004 payments to the back payments they say we owe and are now wanting over $4000.00 or they will foreclose. We went through this with them once before and proved all of our payments were made. Now I am having to do the same thing again. I am so tired of the worry of this and don't know where to turn now. in the year 2000, we closed our loan and it was bought by homecomings...the amount of loan was $119,000.00...to make a long story short, we were forced into bankruptcy because of a failing business we had...we found a finance company who is willing to refinance us, pay off the trustee so we can get out of debt and bankruptcy and start over, and when this refi company called homecomings for the payoff, they said it is $147,000.00 and our payment is next due for august of 2002!!! i tried to find all my receipts, there is NO possible way we are almost 2 years behind...they added on hazard insurance 4 times...all kinds of fees, that make NO sense at all... you need to contact an attorney and get this taken care of...this company needs someone to step in and investigate them...something is definately wrong here...i have 2 years remaining on my bankruptcy, and homecomings or the citicorp never filed a lien on my property...i have my bankruptcy lawyer involved, and i am not going down with out a fight...i will go to the media if i have to..i do have the dept of banking in my state of vermont involved...and this site is great...i am telling everyone i know about it...and i do believe if we all stick together, we can stop these crooks from robbing us blind, and trying to steal everyone's house from them...they are heartless, and with all the complaints i have been reading on here, i am amazed they are still able to operate in this country... Knowing the mortgage industry (as most of those posting have learned the hard way), I find it impossible to believe that this person "missed payments" as far back as 1999 and Homecomings did nothing about it. The response posted by Homecomings appears to be a standard response they most likely use for everyone. I think I would continue working with the bank to get copies of the checks, advise Homecomings in writing with a letter from the bank, certified mail, return receipt requested. If they did receive these payments and you get the proof, you might wish to seek legal assistance. I don't believe you missed all of the payments you have listed without Homecomings doing something about it.
