If you furnish them a copy of the cancelled checks, they can go after KB Homes for the payments. You can either fax them or send them in the mail. Then, they block your credit until the payments are found. They also waive the late charges and fix your credit, if it has been damaged. Is it easier to complain or be pro-active and try helping them to fix the problem? They need your help (the cancelled checks). If the checks are misapplied, you may even get paid for the copies, if you ask. It's worth a try.

Homeside Lending is violating your RESPA rights. You, as the consumer, MUST be notified, in writing of Assignment, Sale or Transfer of Servicing Rights. Section 6 of RESPA gives you certain consumer rights. Section 6 of RESPA also provides for damages and costs for individuals in circumstances (like this) where servicers are shown to have violated the requirements of that Section. You should seek legal counsel if you believe your rights have been violated. (Washington Mutual, Ocwen, Fairbanks - ALL have violated consumer rights and should be sued.)
