18 year old girl goes into House of Power. The salesman told her the payments would only be $50.00 per month. The salesman filled out her credit application. He listed her income at $4000.00 per month, and that she had worked for 24 months. All this was not true. She said that no one asked her income. She just graduated and only works part-time at $7.50 per hour, and is going to college. Even if she worked a forty hour week her monthly income would only be $1200.00 per month. Then the dealer charged her $1495.00 for theft insurance. This made her payment go to $99.00 per month. Now the dealership says she opted against it. So why did they still charge her? The dealership did not give her in writing the terms of the financing. They did not show her that after 24 months the 5.99% interest rate would increase, Or that the payment would balloon. The dealership charged her $ll,162.15 for a KFX700 Kawasaki. The MFSG is only $6800.00. After she realized what they did she took it back unused one hour later. The House of Power told her all sales final! It was not titled at that time. Now, House of Power says if we pay them $2500.00 they will take the four-wheeler back. $2500.00 reward for being fraudulent and deceptive. One angry MOM! The finance company shares blame here also. No one verified income or employment. They gave a girl who is just starting out a huge credit debt. Which if not resolved will be a hardship. It's HSBC and Kawasaki Let the good times roll promotion. I called them too, all they would say is that she's 18 and legal that no one forced her to sign. This is predatory lending. This should be illegal warn your young teenagers who can't legally drink yet. That unethical business practices can ruin their credit.

Several of the posters on this subject do not seem to be abe to do anything but cast stones. It is highly suspect that they are probably employees or owners of Power House. The 72 hour Right of Recision is in force in the state of FL. 72 Hours from the date of possetion. Sunday's and Holidays do not count. While your daughter should with no doubt be embarresed and this will probably jade her for life on the unscrupulous type of people in these dealerships. This could serve in the end as an invaluable lesson the predatory nature of the high ticket retail industry. You have a very good case and I hope to see you take it all the way. Inquire also of filing suit against the finance company. Failure to disclose terms of a contract in full BEFORE signing is a requirement of law. Best OF Luck. T. Clark Palm Bay

The owner of this business has no integrity! My daughter has realized that she made a mistake by trusting people to be professional and trustworthy. She has had a few different jobs. All retail but very reputable companies that allowed refunds with no questions asked. She has expressed repeatedly that she will pay for any fees involved no matter how long it takes.(problem she has limited funds) She's young and easy-going just sees life in the purest way. It's kinda sad, she's untainted by the ways of the world. Yeah she learned her lesson don't trust anyone right! The dealership knew what they were doing. To burdened an 18 year old with a $11,000.00 debt for a 4-wheeler is wrong. Then to not disclose the facts that the payments balloon to at least $250.00 after two years is criminal. This is blatently unfair, and deceptive trade practices. Unfortunatley they broke the law, and my daughter's credit future is at stake. There are laws to protect consumers. Truth in lending Act. The dealership failed to fully disclose the terms of the financing to her in writing. Many mature adults have fallen victim to this in relation to loans secured with their homes. Just do a search here. There are a ton of financing complaints. The maintenance aggreement is also suppose to be fully disclosed in writing as to what it covers exactly. Not just a piece of paper printed sloppily that says non-canceable maintenance aggreement $1495.00 I bet that's really gonna stand up in court. She just started a new semester in school and she met another student that said he just got taken advantage of by a motorcycle company turned out to be the same one. She said he is really upset, and is asking her what he should do. He said that they filled out his credit application to. I am trying to get the dealership to take the 4-wheeler back. Rather than it getting reposessed. I don't like to see anyone suffer with credit problems. It would not have cost the dealership one penny to take this back one hour after she left with it. They are greedy. Another Mom picketed this company. She told me that her son bought a bike from this company and paid approx. $9,000.00 cash. Had the bike for 2 days took it back for service and it got stolen off the dealerships property. The dealership refused to reimburse them for the stolen property. She said that the dealership said her 19 year old had signed a waiver. I recommended to both of these people that they file a report on here, and to the Attorney General. There is definitely a trend to exploit young adults their legal and uninformed. They just want that recreational vehicle. Their first purchase on their own that they think they have a low payment on until it balloons. I am very proud of my daughter, and I would never turn my back on her. Trust me she knows she really got to me with this one. If this is the worst thing she does I guess I'm lucky. I had applied for a visa card and a gas card for her with a $500.00 credit limit. she was only listed as authorized user. I did this willing to pay if she defaulted or got into hard times. I was trying to teach her how to be responsible with making payments before she got credit in her own name. The House of Power, HSBC, and Kawasaki let the good times roll took that parenting lesson right out of my control. I pulled her report after this happened. I did not realize that this would show up under her credit. I still cannot understand how that allowed a credit card company to establish that she could be responsible for an $11,000.00 credit line. when she only had $500.00 existing credit line for less than 8 months and was even listed as an authorized user. It's a shame. I feel sorry for the young adults if credit is this easy to get nowadays. I thought that income and employment verification was mandatory.

Your daughter has just graduated, going to college, so I assume she is living with you and/or you support her. I am a little surprised, that while she had plenty of time to go home two times between hearing about the "great deal", and signing the papers, she did not even try to contact you. What was she thinking? Wanted to impress her friends? You can choose either pay the $2500, or sue them but in any case do NOT LET your daughter get away with this. Ground her, and let her to leave your house ONLY to go to work, till she pays back either the $2500 or the litigation expenses. In college with much more peer pressure what else she will do? When she gets dozens of scam calls everyday? Buy a $200.000 condo, because "she only wants a condo for $100/month"? (Check reports, how many ripoff aimed specially to scam those "naive" youngsters.)

That is a very unfortunate situation. You often read about the elderly being taking advantage of and there are laws to protect them. I think if a company willingly omits information about financing terms, that it should be fraud. Everyone is so concerned about the economy, but when a company can submit false information about someones wages to obtain credit for that customer, so they as a company can make money, it damages the economy. The only winner in this situation is the company making money. The consumers credit will be ruined, the bank will not receive the money they lent, other credit card holders will pay more fees and higher percentage rates, but House of Power will have their money they made on the 4 wheeler, not to mention the money they made on fraudelent charges. I am a 40 year old adult and everytime I have applied for credit, I had to physically provide proof of income as well as length of employment. Cell phone companies check your credit thoroughly before giving you a $200 cell phone account, I cannot beleive this girl was given an $11,000 4-wheeler with no proof of income and no money down. First my comment.... stupidity is not a valid excuse. The dealership is not required to take the vehicle back based on her stupidity. Your daughter is an adult and no one held a gun to her head and forced her to sign. My advice to you is let her handle it herself, she got herself into it let her get herself out of it. Hopefully she can learn from this experience and not make the same mistake next time.

Marc, You obviously did not read all the details. My daughter did sign all the paperwork without reading it. Guilty as charged. But she is not experienced enough to know that she needed to exaggerate her income or her length of employment. My biggest complaint is how anyone could give an 18 year old $11.162.00 in credit card debt. without a deposit, without verifing income or length of employment. She went there with a group of friends. She did not go there intending to purchase anything the salesmen is the one that kept telling her he could run her credit for free. She had to go home to get her driver license, when she got back the salesmen asked for her social security number. She had to go back home to get that. She is naive.She has never made a large purchase. And this company totally took advantage. They charged her $200.00 to assemble a four-wheeler that was already assembled. They charged her $300.00 for warehousing a stock item. They charged her $249.50 for processing. They charged her $650.00 for a service contract. they charged her $1495.00 for a maintenance agreement that is not cancellable. She was not trying to get anybody. All she wanted was a four-wheeler for $99.00 per month. Had the dealer disclosed the terms of the financing or even requested a down payment she would have had to leave and think about it. The dealer had no signs posted that all sales were final. If the dealer was reputable they would have alowed her to return it that same night. Of course they are going to fight this they have already been funded their money and they made a huge profit. Right now, I am searching for advice to help her so that her credit does not get ruined. She can't even refinance because of all the bogus charges. The bank will only loan on the value of the 4-wheeler. which is only about $6800.00. Any helpful advice welcomed.

You say "HE" listed her income at $4,000 a Month. Sounds like "SHE" listed it that way. She knew it was a lie nonetheless and signed the application. If I was the dealer I'd say go ahead and sue me. Meanwhile, your daughter would be arrested and charged with felony grand theft. Sorry Mom, this is your daughter's fault. She thought she was scamming Kawasaki but the salesman scammed her in the process.

January update. House of Power refuses to take 4-wheeler back. unless we give them $2500.00. Told us to sue them. We offered them $500.00 and the return of the unused 4-wheeler. They said no deal. My attorney is filing suit!
