The owner of that particular JD by rider also owned courtesy kia in alliance which if you watched the papers was sued and the owners and managers brought up on charges because of fraud, for bad insurance claims, not paying off trade ins, and a whole assortment of violations.

company? Especially when your credit is on the line here! It is not the responsibility of any dealership to do such a thing, and taking ANYONE's word on it is your fatal judgment call on this one. It's nice that your insurance company is trying to help in this matter. You also state that your insurance company never sent any payoff to them. That speaks volumes right there. Did you have it insured through another company? Again, why did you not follow up on this. What Kae explained is absolutely accurate. Just because the vehicle was totaled out doesn't necessarily mean you won't end up owing something on it. Vehicle is sold for $20,000. You paid up to $10,000. There is $10,000. left. The insurance adjuster comes and they total the vehicle out. The bluebook value is a whopping $7,000. That leaves you owing the remaining $3,000 balance on the vehicle loan. No, it doesn't sound fair, but it is just the way it is and is standard with ANY loan company. However, from the amount you say you were told you still owed sounds about right if you think about it. I just wonder why you had not been told about this outstanding amount owed. You can try to contest this with the credit bureau's, due to the fact they are no longer in business. It sounds like you could very well get it wiped off of your report, BUT make sure you obtain up to date copies from all credit bureau's and do the samething with each and every one of them. Normally when something is contested, the bureau will request info from said company. They have no record of this in any way shape or form, so they can not respond. If they do respond, you know for a fact that your records are out there somewhere and the bureau will tell you from where that info came from! I hope this helps you guys out. But, God Forbid this type of thing EVER happen again (tell that hubby to stay awake at the wheel!!), PLEASE do not take it for granted that it is taken care of!! Follow up, Follow Up, Follow Up!

I also forgot to add that the day after the wreck J D Byrider gave John a Dodge Stratus. J D Byrider said they worked w/ the mechanics at the garage that had the truck & they would get the estimate paperwork & settle it all w/ Nationwide Insurance cause they were the actual title holder of the 1996 Ford Ranger that got wrecked & John didn't have to worry about anyhting. I just iound out they filed Bankrupctcy in 2005. When I called other local J D Byriders they said they never knew Alliance, Ohio had a J D Byrider there. They said most of them are now Independent stores. So my husbands insurance has no vehicle, no pictures of the damage done to truck or no written estimate that was promised by J D Byrider. But he does have this truck against him in the credit bureau. It's sad they get to rip people off daily in so many different states & file bankruptcy & walk away. Well they never filed anything. So now my husbands credit is ruined & they get nothing out of it. I don't understand how the GOVERNMENT can allow these J D Byriders to continue ripping people off & ruining their lives & their credit. My husband paid the insurance on this truck & should of been compensated some how. Let the owner sell his d**n car or house & give my husband the money to clear his credit. Maybe everybody w/ a car from J D Byrider should file bankruptcy & let them see how it feels to be ripped out & have your name & credit ruined. We can't locate any information on the Owner of the store in Alliance, Ohio. It is as if it never existed. Stay away from J D BYRIDER!!!

Ok the creditor your speaking of is J D BYRIDER. Not AlLIANCE ONE. My question is WHY WOULDNT YOU CALL YOUR OWN INSURANCE TO FILE A CLAIM ON AN ACCIDENT? It is not up to the creditor to do so. If they did that was above and beyond. Now there is such a thing called defiecny balance. Example: if you bought a care for $20k and you paid it down to $10k by the time you got in your accident and the car was totaled out the insurance claim YOU filled the accident with will have there inspector come out verify it is totaled and they will figure how much the car is blue book valued at approx. and then say it your car was worth $7k....that would leave $3k a a balance the customer has to pay the difference. This is why care dealerships offers GAP insurance. In case the above happens to someone. The question is now....How far can you go back to file a claim with your insurance? If so you still have a chance to have them pay this. UNLESS it is a defiency balance! Good luck
