My daughter had just moved into an apartment in Austin, Tx and she had not even been there no more than a week and her car was towed by J&J Towing. They refuse to listen that her car was parked legally. She took photos of all of the cars that were parked within the same area and all over the complex to show that she was parked in a legal area.

The towing company gave me a total of $192.00 that would release the car but it is the apartment complex and the towing company responsibility to not tow cars illegally. If you were to ask me... You would think these companys are in scams with each other. I am a very pissed off parent right now. I am very tired of people ripping off the innocent and hardworking people and college students who are trying to get an education.

Its not just the towing company. Its the apt company who is in co-hoots with them. There is visitor parking but only the labeled spots. the last 6 that have no paint that says visitor and theyare the ones they tow from. So they dont tell you that and they are protected and the apt gets a kick back.

We already have three Justice Court cases filed against parking facilities that J&J tows from because the parking facility is not in compliance with Chapter 684 of Texas Transportation Code. If you paid a $192 to get your vehicle backed from J&J Towing, you could be entitled to $948 in damages paid by the property manager for giving J&J Towing authorization to tow your vehicle. We help victims of illegal towing everyday. J&J Towing has already been busted by the Austin Police Department for towing vehicles just like your situation.

Marc is right on this one. Every state law varies slightly, but in most cases, it is the property manager or owner that must request and authorize the tow. Furthermore, towing from private property without a request can only be done from a clearly marked spot that indicates the parking restrictions. You have recourse against the towing company AND the apartment owner. Document all expenses like cabs, lost work, etc..File a lawsuit. Find out who the actual driver was and file auto theft charges. This happens all too often as many tow drivers are paid on commission and are a little too eager to do the PPI tows. These are private properties who have agreements with the tow company to tow all vehicles or tow from posted locations during certain hours, etc.

If she is sure the car was parked legally, she should have called the police immediately and started a theft investigation. My experience is that she most likely parked illegally and doesn't want to admit it to you. Who do you think is scamming, the apartment complex, the towing companies, or both? Or could it be the illegal parkers themselves, upset that they thought they could get free parking on someone else's property and got caught?
